[ LTFRB MEMORANDUM CIRCULAR NO. 2011-008, September 05, 2011 ]

EXEMPTING CERTAIN CAR-RENTAL SERVICES FROM THE COVERAGE OF MEMORANDUM CIRCULAR NO. 98-027 (RE: FRANCHISE FOR DUMP TRUCK AND OTHER PRIVATE VEHICLES USED AS "FOR HIRE")



The Board on 25 September 1998 issued Memorandum Circular No. 98-027 requiring dump/cargo trucks or private vehicles rented out for a fee to apply for and secure franchises from this Board or from the regional offices in their respective jurisdictions, in order to legitimize their operation.

After consultation with various transport groups and upon careful review of the existing rules regarding this matter, there is a need to amend the said Circular in order to exclude from the coverage thereof certain car-rental services.

In view hereof, private vehicles rented out are hereby exempted from the coverage of the above-said Circular subject to the following conditions:

  1. Private vehicles must be covered by a long-term lease contract between the lessee and the car rental company/owner; OR
  2. The vehicle must be exclusively used and driven by the lessee or his/her authorized representative

All other rent-a-car owners whose services do not fall within the said exemptions are still covered by M.C. 98-27.

This Memorandum Circular supersedes all issuances inconsistent herewith and shall take effect fifteen (15) days, following its publication in a newspaper of general circulation and after filing three (3) copies hereof with the UP Law Center pursuant to Presidential Memorandum Circular No. 11 dated 09 October 1992.
