[ IPO OFFICE ORDER NO. 185, S. 2010, December 06, 2010 ]

SWORN STATEMENT OF SMALL ENTITY



WHEREAS, it is the policy of the State to streamline administrative procedures; WHEREAS, Rule 400 of the Trademark Regulations requires the submission of sworn statement that the applicant is a small entity if such be the fact;

WHEREAS, the processing of applications gets delayed due to non-compliance of the requirement to submit sworn statement of small entity;

WHEREFORE, Rule 400 (o) of the Trademark Regulations is hereby deleted from the requirements.

All rules and regulations, memoranda, circulars, and memorandum circulars or parts thereof inconsistent with this Rule are hereby repealed.

Examiners are hereby instructed to advise clients to observe the change in the requirements.

Ms. Ana Maida Zamora, Administrative Officer V, Bureau of Trademarks, is hereby directed to immediately file three (3) certified copies of this Office Order with the University of the Philippines Law Center, and one (1) certified copy each to the Senate of the Philippines, the House of Representatives, the Supreme Court of the Philippines, and the National Library.

Mr. Restituto E. Maligaya, Information Technology Officer III, MIS Bureau, is hereby directed to immediately post this Office Order in the IPO website and to remove the downloadable Sworn Statement of Small Entity form therefrom.

This Office Order shall take effect after fifteen (15) days following the completion of its publication in a newspaper of general circulation.
