WHEREAS, the present Standard Terms and Conditions Governing the Employment of Filipino Seafarers on Board Ocean-Going Vessels took effect on September 2000 while Section 20 of the same became effective on June 2002 due to a restraining order on the section’s implementation;

WHEREAS, there are developments in the international maritime industry affecting the recruitment and employment of Filipino seafarers on ocean going ships, such as the formulation of ILO Maritime Labor Convention, 2006, which seeks to further promote decent conditions of work for seafarers;

WHEREAS, there is a need to adapt to such developments in the international maritime industry in order to provide better protection for Filipino seafarers;

WHEREAS, Filipino seafarers are the preferred choice in the global ship manning industry and the continued protection of their rights will help ensure their global comparative advantage and continued employment;

WHEREAS, a tripartite meeting was organized in May 2008 to initiate a review of the existing Standard Terms and Conditions Governing the Employment of Filipino Seafarers;

WHEREAS, a technical working group composed of tripartite representations was subsequently created and consultations made with relevant government and private sector representatives on the review of the said Standard Terms and Conditions;

WHEREAS, a draft of the revised Standard Terms and Conditions was finalized in September 2010 after the integration of relevant provisions of Republic Act 8042 (The Migrant Workers and Overseas Filipinos Act of 1995), as amended by Republic Act 10022 which was approved on 08 July 2010 and became effective on August 14, 2010;

NOW, THEREFORE, the POEA Governing Board, in a meeting duly convened, RESOLVES, AS IT IS HEREBY RESOLVED, to approve the attached^* proposed Revised Standard Terms and Conditions Governing the employment of Filipino Seafarers, 2010;

The POEA shall formulate the guidelines for the implementation of the amended Standard Terms and Conditions Governing the Employment of Filipino Seafarers. This Resolution shall take effect 15 days from publication of the Implementing Guidelines in a newspaper of general circulation.
