AN ORDINANCE REQUIRING ALL BARANGAYS OF THIS CITY TO DESIGNATE AT LEAST TWO (2) BARANGAY PUBLIC SAFETY OFFICERS (BPSO) AS TRAFFIC ENFORCERS WHO SHALL UNDERGO BASIC TRAFFIC MANAGEMENT SEMINARS TO BE CONDUCTED BY THE DEPARTMENT OF PUBLIC ORDER AND SAFETY OF QUEZON CITY, AND SHALL BE AUTHORIZED TO ISSUE ORDINANCE VIOLATION RECEIPTS (OVR).

WHEREAS, if is evident that Quezon City is one of the nation's fastest-growing metropolis, both economic and population-wise.  This development has led to atrocious traffic congestions and, if not addressed properly, may cause disruption in the financial growth of the community;

WHEREAS, Section 16 of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, provides that every Local Government Unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate' or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare;

WHEREAS, Section 389 of the same Code, also provides that the Punong Barangay, as the chief executive of the barangay government, shall exercise such powers and perform such duties and functions, as provided by this Code and other laws, maintain public order in the barangay and, in pursuance thereof, assist the city or municipal mayor and the sanggunian members in the performance of their duties and functions;

WHEREAS, the City's Department of Public Order and Safety (DPOS) has an existing procedure to which the deputation of Barangay Public Safety Officers (BPSO) and Traffic Enforcers to issue Ordinance Violation Receipts (OVR) is grounded.

NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF QUEZON CITY IN REGULAR SESSION ASSEMBLED:

SECTION 1. TITLE - This Ordinance shall be known as the "Barangay Traffic Enforcement Ordinance".

SECTION 2. DESIGNATION OF TWO (2) BARANGAY PUBLIC SAFETY OFFICERS (BPSO) AS TRAFFIC ENFORCERS - The Local Government of Quezon City, through this Ordinance, shall require all Barangays of this city to designate/appoint at least two (2) of their existing Barangay Public Safety Officers (BPSO) to undergo a series of Training/Seminar, to be conducted by the Quezon City Department of Public Order and Safety (DPOS), and be deputized to issue Ordinance Violation Receipts (OVR), for the effective enforcement of Traffic Rules and Regulations within their barangay.

SECTION 3. PURPOSE - It is the intention of the proponent of this Ordinance to provide the necessary Traffic Enforcement Personnel particularly in the demanding financial districts of the city.

SECTION 4. APPROPRIATION - The appointment of Barangay Public and Safety Officers (BPSO) shall be taken from barangay funds as provided for by the Local Government Code, while the conduct of seminars/trainings shall be pursuant to the existing procedure of Quezon City Department of Public Order and Safety (DPOS) and shall be taken from the city funds.

SECTION 5. SEPARABILITY CLAUSE - If any part or section of this ordinance is declared unconstitutional for any reason whatsoever, such declaration shall not in any way affect the other parts or sections of this ordinance.

SECTION 6. REPEALING CLAUSE - All ordinances, resolution, executives orders, rules, regulations, and other administrative issuances, or the provisions thereof, which are contrary to or inconsistent herewith, are hereby repealed, or modified accordingly.

SECTION 7. EFFECTIVITY - This ordinance shall take effect within fifteen (IS; days following its publication in any newspaper of general circulation,
