WHEREAS, Section 19 (1), Article XIV, of the 1987 Constitution provides that "The State shall promote physical education and encourage sports programs, league competitions, to foster self-discipline, teamwork and excellence for the development of a healthy and alert citizenry":

WHEREAS, paragraph 2 of the above-quoted constitutional provision states further that "All educational institutions shall undertake regular sports activities throughout the country in cooperation with athletic clubs and sectors";

WHEREAS, Republic Act No. 6847 created the Philippine Sports Commission (PSC) under the Office of the President to carry out this constitutional mandate in coordination with various government departments and private entities:

"Section 2. Declaration of Policy. - It is the policy of the State to promote physical education, encourage and sustain the development of sports in the country to foster physical fitness, self-discipline, teamwork and excellence for the development of a healthy and alert citizenry through a unified national sports promotion and development program, and that the establishment and creation of a single, unified and integrated national sports policy-making body shall further this objective."

WHEREAS, Republic Act No. 7160 (Local Government Code of 1991) under the General Welfare clause provides that "Every local government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective governance, and those which are essential to the promotion of the general welfare. Within their respective territorial jurisdictions, local government units shall ensure and support, among other things, the preservation and enrichment of culture, promote health and safety, enhance the right of the people to a balanced ecology, encourage and support the development of appropriate and self-reliant scientific and technological capabilities, improve public morals, enhance economic prosperity and social justice, promote full employment among their residents, maintain peace and order, and preserve the comfort and convenience of their inhabitants:

WHEREAS, the Quezon City residents have great aptitude in sports and other physical activities and many talented individuals in the field of sports strive hard to attain excellence but because of their incapacity to afford sports equipment, uniforms, training fees and other miscellaneous, tend to withdraw their goals in achieving a career in the field also due to the absence or lack of support from the local government;

WHEREAS, the Quezon City government can yield a steady supply of sports-minded youth and athletes for national and international competitions if the City Government will exert the full support that the athletes need, to boost their morale, maximize their potentials for triumph, and inspire them to play their best for the city during competitions and other sports activities;

WHEREAS, the Quezon City government seeks to establish a Sports Talent Identification, Promotion and Development Program in order to discover and develop fresh athletes who will someday represent the City competently in any level of sports competitions and then subsequently become national athletes who will represent and bring honor and glory to this great nation;

WHEREAS, the Amoranto Sports Complex is the agency responsible in promoting and encouraging the development of sports for the constituents of Quezon City;

WHEREAS, the sports complex serves as the venue in fostering physical fitness and the development of a healthy and alert citizenry. It provides the facilities to accommodate not only for various sports events, but to socio-civic activities as well for Quezon City residents, students of various schools, athletic groups and other sports associations.

WHEREAS, the Office of the City Mayor appointed an Officer-ln-Charge of the Amoranto Sports Complex, a sports center.

NOW, THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF QUEZON CITY IN REGULAR SESSION ASSEMBLED:

SECTION 1. This Ordinance shall be known as the "Sports Talent Identification, Promotion and Development Program of Quezon City."

SECTION 2. Declaration of Policy - It is the declared policy of the-Quezon City government:

1. To develop a sports program in providing opportunities to bring out the best in aspiring individuals and elevate them to the highest level of competency in sports;
   
   
2. To encourage all sports aficionados and organizations to foster a development program in an atmosphere of cooperation and participation;
   
   
3. To draw commitment from public officials, institutions and other nongovernment organizations to support the Quezon City residents to be active in sports; and
   
   
4. To encourage Quezon City residents to patronize sports and to keep them away from vices such as illegal/prohibited drugs, cigars and cigarettes, liquors, and other alcoholic beverages.

SECTION 3. Definition of Terms

1. Applicant - any individual or group of individuals who are requesting and/ or soliciting sports uniforms, equipment, supplies, and other gadgets. This includes coaches, referees, and table officials and other persons conducting official capacities in any given sports.
   
   
2. Excessive liquor/alcohol consumer - drinking four (4) standard drinks on any single day and/or drinking fourteen (14) standard drinks during any given week.
   
   
3. Trainers - one who instructs players in the fundamentals and/or advance stages of a particular sports and directs team strategy;
   
   
4. Sport -  An activity involving physical and mental exertion of skills in which an individual of team competes against another individual or team. A physical activity that is governed by sat of rules or customs and often engaged in a competitive manner. This includes indoor games such as, but not limited to, chess, scrabble, games of the generals and other board games.
   
   
5. Sports Competitions - refers to a particular sports played by two or more individuals or two or more group or team with the primordial aim of garnering the highest score or the highest team standing as the case may be.
   
   
6. Sports Equipment - this refers to any and all sports equipment or gadgets that are uniquely or particularly used in any given sports. This includes the prizes such as but not limited to medals, plaques, trophies, tokens, etc.
   
   
7. Sports Events - this includes fun runs and other sports for-a-cause activities;
   
   
8. Sports Leagues - a group of sports teams or individual athletes that compete against each other in a specific sport.
   
   
9. Sports Programs - this refers to the general features and components of a particular sports, recruitment, training, tournaments, and invitationals.
   
   
10. Sports Uniforms - refers to any sportswear which varies depending on the kind of sports. This includes jackets, caps, sun visors and shades
    
    
11. Student - any bonafide individual duly enrolled in an educational institution either public or private;
    
    
12. Talent - refers to the natural aptitude or skill of a person
    
    
13. Talent Identification - a process of identifying the individual's potentials and skills in any particular field of sports.
    
    
14. Training - the process of bringing an individual or a team to an agreed standard of proficiency by instructions and practice

SECTION 4. Qualifications for Solicitations

1. Individual - any person, irrespective of age, race, creed, or religion can avail the benefits of this ordinance. The said individual should be validly enlisted in a competition, league, or any particular sports event in which the former can enhance and boost his/her physical well being;
   
   
2. Group - Hie persons composing the group should all be members of a single team under a particular game or sports that is played by two or more persons which includes but is not limited to basketball, volleyball, soccer, rugby, football, including local and native sports games usually played during intramurals and other sports festivals;

SECTION 5. Scope of Benefits

1. For Students - sports uniforms, equipment and supplies.
   
   
2. For Athletes - sports uniforms, equipment and supplies.
   
   
3. Players - sports uniforms, equipment and supplies.
   
   
4. Government Employees - spoils uniforms, equipment and supplies.
   
   
5. Senior Citizens and Persons with Disabilities (PWD's) - sports uniforms, equipment and supplies, snacks and energy drinks.
   
   
6. Out-of-school individuals - sports uniforms, equipment and supplies
   
   
7. Members of other Organizations - sports uniforms, equipment and supplies.

SECTION 6. Application Procedure

1. Application
   
   
   1. For Students (elementary and high school) - the request letter should be signed by the class adviser or in her absence the school principal. Together with a certification of the class adviser or principal that the applicant is not a smoker and is not a consumer of liquor or alcoholic beverages.
      
      
   2. For Individuals (18 and above) - the request letter should be signed by the requesting individual with an attached certificate of non-use of illegal drugs and the affidavit of a third party stating that the applicant is not a smoker and is not a heavy consumer of liquors and other alcoholic beverages.
      
      
   3. For Teams/Group - the letter request should be signed by any and should be limited only to the: team coach, team manager, school principal, and president or chairman or head of the organization. For Teams or Group coming from the barangay level, the letter request should be signed by the incumbent Punong Barangay.
      
      
2. Offices exclusively authorized to receive the applications:
   
   
   1. Office of the City Mayor
      
      
   2. Office of the Vice Mayor
      
      
   3. Offices of the City Councilors
      
      
   4. Office of the President of the Liga ng mga Barangay
      
      
   5. Office of the President of the Sangguniang Kabataan

SECTION 7. Implementing Office - The Office of the City Mayor, through the Officer-In-Charge of the Amoranto Sports Complex, the City Administrator and the City Treasurer, is hereby mandated to promulgate the implementing guidelines for the effective implementation of this ordinance.

SECTION 8. Disqualification

1. As a pre-condition to avail the benefits of this Ordinance, applicants should be non-smoker, non-excessive consumer of liquors and/or alcoholic beverages and non-user of illegal/prohibited drugs. Each applicant and/ or beneficiary of this ordinance should submit, as a condition, a certificate for negative use of prohibited/illegal drugs from a duly certified laboratory clinic. Lastly, there should be an affidavit by a third party stating that the applicant is not a smoker and not a heavy consumer of liquors or alcoholic beverages.
   
   
2. The following are disqualified to avail the benefits of this ordinance:
   
   
3. Those found to be positive in the use of illegal/prohibited drugs;
   
   
4. Consumer of cigars, cigarettes and other tobacco products;
   
   
5. Excessive consumer of liquors and alcoholic beverages for 18 years of age and above;
   
   
6. Consumer of liquors and alcoholic beverages for those below 18 years of age;

SECTION 9. Screening Committee - There shall be a screening committee composed of three (3) individuals chosen by the City Mayor coming from the employees assigned in the Amoranto Sports Complex who are tasked to scrutinize and check the requirements of each and every applicant and to approve those applications possessing all the qualifications and having none of any of the disqualification herein-enumerated.

SECTION 10. Purchase of Sports Equipment - The provisions of Republic Act No. 9184 shall govern the procedure in the bidding and purchase of sports uniform, equipment, gadgets and foods, beverages and other supplies.

SECTION 11. Training of local coaches, trainers, and referees - The Quezon City government shall invite professional coaches, trainers and referees from various sports events as consultants to train our local coaches, trainers, and referees on the standard rules and techniques for their respective events and improve their performances, both during trainings and competitions. The Quezon City government shall shoulder the fees for such consultations to be taken from the budget appropriated for this purpose.

SECTION 12. Appropriation - The necessary budget needed for the implementation of this Ordinance shall be included in the General Appropriations Budget for the year 2014 and for the following years.

A special fund to be known as the "Sports Promotion and Development Program Fund" shall be created and shall be used solely for the programs initiated under this ordinance. The said special fund shall be included in the budgetary allotment of the Amoranto Sports Complex.

SECTION 13. Auditing Procedure - The general and special laws, rules and local ordinances related to auditing procedure shall be applied to this Ordinance.

SECTION 14. Annual Report - The City Budget Department and the Officer-In-Charge of the Amoranto Sports Complex are hereby mandated to prepare an annual report to be submitted to the City Council every third week of January of the following year. The report should summarize the statistical data of those who have benefitted from this Ordinance, the total amount spent and the corresponding balance if any. Included in the annual report should be his suggestions and recommendations for further improvements and revisions of this Ordinance.

SECTION 15. Repealing Clause - All ordinances, resolutions, local executive orders, rules and regulations or any part thereof which are inconsistent with any of the provisions of this ordinance are hereby repealed, modified or amended.

SECTION 16. Separability Clause - If any of the provisions of this ordinance is declared unconstitutional or invalid by a competent court, the other provisions hereof shall continue to be in full force and effect.

SECTION 17. Effectivity Clause - This ordinance shall take effect fifteen (15) days after its publication in a newspaper of general circulation.
