SANGGUNIANG PANLUNGSOD

**Excerpts from the minutes of the 60th Regular Session of the 6th City Council of Valenzuela held on November 17, 2014 at 3:11 P.M. at the City Council's Session Hall, 3rd Floor, Legislative Building, Valenzuela City Hall, Karuhatan, Valenzuela City, Metro Manila.

AN ORDINANCE IMPOSING FEES FOR MOVIE, TELEVISION/ ADVERTISEMENT AND/OR PROGRAM/SHOW FILMING, SHOOTING, TAPING OR VIDEO PRODUCTION CONDUCTED WITHIN THE GOVERNMENT FACILITIES OF VALENZUELA CITY.

WHEREAS, some private businesses and entities are using the premises of various city government facilities and structures such as the city hall complex and other city government structure, buildings, and parks to conduct movie and television filming, and other entertainment activities;

WHEREAS, Section 458 Paragraph (2) (ii) of the RA 7160 or the "Local Government Code of 1991” states that the Sangguniang Panlungsod shall:
(ii) Subject to the provision of Book II of this code and applicable laws upon the majority vote of all members of the Sangguniang Panlungsod, enact ordinances levying taxes and charges, prescribing the rates thereof for general and specific purposes, and granting tax exemptions, incentives or reliefs;”
NOW THEREFORE, be it ORDAINED as it is hereby ORDAINED by the Sangguniang Panlungsod of Valenzuela, in a session duly assembled, that:

SECTION 1. DEFINITION OF TERMS. For the purpose of this Ordinance, the following terms shall be understood in the sense indicated hereunder:
  1. THE CITY HALL COMPLEX - refers to the Valenzuela City Hall Executive and Legislative Buildings, Gusaling Geronimo S. Angeles and Social Hall located in Barangay Karuhatan, Valenzuela City maintained, owned and/or operated by the City Government of Valenzuela.

  2. THE CITY HALL PREMISES - refers to any open space in the City Hall Complex or pan thereof consisting of bare grounds (concrete pavements or otherwise) not covered by the city hall buildings.

  3. OTHER GOVERNMENT STRUCTURES - refers to any structures or facilities built, maintained or owned by the City Government of Valenzuela.

  4. FILMING, SHOOTING, TAPING - refers to the process, art or businesses or producing movies, TV advertisements, soap operas/drama series; To record something (as on Film or videotape) with a camera.
SECTION 2. SCOPE AND COVERAGE. Film and video production entities, which intend to carry out filming, shooting, or taping of movies, television advertisements, soap operas/drama series should secure the following steps at least three (3) working days; seventy two (72) hours prior to conducting any activity within the City Government facilities/premises:
  1. Submit a "Letter of Request" addressed to the City Mayor to the Building Administration and Records Office located at the 2nd Floor, Executive Building, the City Hall,  MacArthur Highway, Barangay Karuhatan, Valenzuela City. All requests must include the following information:

    • Date(s) and time(s) of shoot
    • Specific location of shoot
    • Schedule of ingress and egress
    • Name of Project
    • Nature of project
    • Contact information of the requesting party including fax number and email address

  2. Secure a copy of the "Film and Video Permit" from the City Building Administration and Records Office.
  3. Submit the filled-up permit at the City Building Administration and Records Office.
  4. The City Building Administration and Records Office will contact the requesting party if the permit/s is available for pick-up or if requested, will fax the approved permit to the fax number on the request.
SECTION 3. IMPOSITION OF FEES OR CHARGES. The City Government of Valenzuela hereby imposes a fee of FIFTY THOUSAND PESOS (Php50,000.00) for the first five (5) hours including ingress and egress of the production equipment for the use of the government facilities and premises such as but not limited to the city hall complex, other city government structures or building and parks for the conduct of movie and television film and video production unless said fee is otherwise waived by the city government and a cash bond of TEN THOUSAND PESOS (P10,000.00) shall be deposited by the Film and Video Production entities in addition to the fees imposed by the City Government to defray the expenses for any damages that may be incurred during the filming or shooting. Said cash bond is refundable at the end of the activity.

An additional of TEN THOUSAND PESOS (Php 10,000.00) will be charged for every hour in excess of the 5-hour provision.

Payment should be made in full prior to filming, shooting or taping proper. In case of excess on the agreed number of hours, payment should be settled before egress to the authorized city government personnel.

This requirement is waived for student and amateur film projects. A separate permit will be provided by the City Building Administration and Records Office. Student/s must present a current student ID before a permit is approved.

SECTION 4. HOURS FOR FILMING OR VIDEO SHOOTING. No filming, shooting and taping shall occur between the hours of 8:00 A.M. to 5:00 P.M. from Monday to Friday. The permit applies the hours of 6:00 P.M. to 6:00 A.M. only in order not to disrupt the city government's provision of public service. Shooting before or after this time frame is strictly prohibited, unless special approval is provided by the Office of the Mayor.

During Saturdays and Sundays, the movie, television and other entertainment production entities may use the facilities subject to the approval of the city, government.

SECTION 5. USE OF VIOLENCE, GUNS AND OTHER EXPLOSIVES. The City Government of Valenzuela will prohibit if the requirement depicts violence, drugs, gangs, the use of guns, pyrotechnics, explosives, smoke or use of flammable liquids.

SECTION 6. BULLHORNS AND SIRENS. Public address systems or other similar noise producing equipment is prohibited.

SECTION 7. NUDITY/PROFANITY. Filming, shooting and taping with nudity or nakedness and profanity or use of profane language are strictly prohibited.

SECTION 8. ALTERING OF CITY PROPERTY. City properties, building / office signages, street signs, parking zones, etc., shall not be removed, defaced, or altered in any way unless special authorization has been granted in the permit issued by the Office of the City Mayor.

SECTION 9. STOPPING OF VEHICULAR OR PEDESTRIAN TRAFFIC. No vehicle or pedestrian traffic shall be stopped in excess of five (5) minutes during filming activities unless otherwise specifically authorized by the Office of the Mayor.

SECTION 10. PROCEEDS OF INCOME. The income that may be generated from the collection of the said fees or charges shall go to the coffers of the City Government of Valenzuela solely to finance improvements, maintenance and repair of the government facilities of the city government.

SECTION 11. CLEAN AND RESTORE. All city government property, including streets, shall be cleaned and restored to the same condition as it existed prior to the filming, shooting or taping activity. In case of property damage caused during the duration of activity, the film and video production shall replace and/or pay all costs incurred by the city government to repair the same

SECTION 12. HOLD HARMLESS / LIABILITY AGREEMENT. The film and video production entities shall defend, without cost, indemnify, and hold harmless,  the City Government of Valenzuela, its City Mayor,  Department Heads, employees, personnel, from all actions, suits, claims, damages, losses and liability or any kind whatsover, including attorney's fees for any injury to, or death of, person or damage to property including the city government property, which arise in any connection with the filming activity for which are cause by (in whole or in part) the said entities, its owners, producers, managers, employees, agents, or any person/s acting with the knowledge or consent (express or implied), regardless of whether any act, omission, or negligence active, passive or concurrent of the city government as a whole contributed thereto.

SECTION 13. IMPLEMENTING AUTHORITY. The Office of the City Building Administration and Records through its Building Administrator in coordination with the Public Information Office (PIO) is hereby authorized to implement the provisions of this Ordinance.

SECTION 14. SEPARABILITY CLAUSE. If for any reason, a part of this Ordinance is declared illegal or invalid, other parts or provisions hereof which are not affected thereby shall remain valid and in full force and effect.

SECTION 15. REPEALING CLAUSE. All previous Ordinance and rules/ regulations inconsistent with the provisions hereof are deemed repealed or modified accordingly.

SECTION 16. EFFECTIVITY. This Ordinance shall take effect fifteen (15) days after its publication in a newspaper of general circulation.
