[ BAI MEMORANDUM ORDER NO. 11, S. 2013, April 01, 2013 ]

LIFTING THE TEMPORARY BAN ON THE IMPORTATION OF DOMESTIC AND WILD BIRDS AND THEIR PRODUCTS INCLUDING POULTRY MEAT, DAY OLD CHICKS, EGGS AND SEMEN ORIGINATING FROM NEW SOUTH WALES AUSTRALIA



WHEREAS, based on the official report submitted by Dr. Mark Schipp, Chief Veterinary Officer, Department of Agriculture, Fisheries and Forestry, Australia (DAFF) to the Office Internationale des Epizooties (OIE) last March 27, 2013, the Avian Influenza event in New South Wales Australia was officially resolved last March 20, 2013.

WHEREAS, appropriate surveillance has been completed to demonstrate the outbreak of Highly Pathogenic Notifiable Avian Influenza (HPNAI) in poultry has been contained and eradicated;

WHEREAS, in compliance with Article 10.4.4, Chapter 10.4 Avian Influenza of the OIE Terrestrial Animal Health Code, New South Wales, Australia is now free of the H7N7 HPNAI;

WHEREAS, based on the evaluation of the Bureau of Animal Industry (BAI), the risk of contamination from importing poultry and poultry products from New South Wales, Australia is negligible;

NOW, THEREFORE, I, PROCESO J. ALCALA, Secretary of the Department of Agriculture, by the powers vested in me by law, do hereby lift the temporary ban on the importation of domestic and wild birds and their products including poultry meat, day old chicks, eggs and semen originating from New South Wales, Australia.

All import transaction of the above products shall be in accordance with the existing rules and regulations of the Department of Agriculture, Bureau of Animal Industry and National Meat Inspection Service (DA-BAI-NMIS).

All orders, rules and regulations or parts thereof, which are inconsistent with the provision of this Order, are hereby repealed or amended accordingly.

This ORDER shall take effect immediately.
