[ BFAR FISHERIES ADMINISTRATIVE ORDER NO. 167-3, S. 2013, March 26, 2013 ]

AMENDING FISHERIES ADMINISTRATIVE ORDER NO. 167, SERIES OF 1989



Pursuant to Sections 95 and 107 of Republic Act 8550 or the Philippine Fisheries Code of 1998, the following amendments to Fisheries Administrative Order No. 167 (FAO 167), series of 1989, are hereby enacted for the information and guidance of all concerned.

Section 1. Prohibition. - Section 2 of FAO 167 is hereby amended as follows:

“Section 2. Prohibition. - It shall be unlawful for any person, association, or corporation to kill or catch, or cause to be killed or caught or taken from those waters, purchase, sell, offer or expose for sale, or have in his possession or under his control any sexually mature sardines, herrings or mackerels or their larvae, fry or young known locally as “lupoy,” “silinyasi,” “linatsay” or “manansi” during the closed season from November 15 to February 15, inclusive, of every year, in that portion of the Visayan Sea and adjoining waters enclosed by line drawn through the following points and coastlines: from the mouth of Danao River in Escalante, Negros Occidental on the northeastern tip of the Bantayan Island to Madridejos, thru the lighthouse on Gigantes Island, to Olutaya Island, to Culasi Point in Capiz province, eastward along the northern coast of Capiz to Bulacaue Point in Carles, Iloilo, southward along the eastern coast of Iloilo to the mouth of Talisay River, westward across the Guimaras Strait to Tomonton Point in Occidental Negros, eastward along the northern Coast of the Island of Negros and back to the mouth of Danao River in Escalante, Negros Occidental.”

Section 2. Penal clause. - Section 3 of FAO 167 is hereby amended as follows:

“Section 3. Penal clause. - Violation of the prohibition stated in the preceding section shall subject the offender to imprisonment of six (6) months and one (1) day to six (6) years and/or fine of six thousand pesos (P6,000.00), and by forfeiture of the catch and cancellation of fishing permit or license.

Section 3. Repealing clause. - All administrative orders, rules and regulations or parts thereof which are inconsistent with the provisions of this order are hereby repealed.

Section 4. Effectivity. - This administrative order shall take effect fifteen (15) days after its publication in a newspaper of general circulation and upon filing with the Office of the National Administrative Register.
