IMPLEMENTING GUIDELINES FOR THE REGISTRATION OF AQUACULTURE STRUCTURES IN THE LAGUNA DE BAY AND THE SEVEN CRATER LAKES

To effectively and efficiently regulate the aquaculture operations in the Laguna de Bay and the Seven Crater Lakes, the following guidelines shall serve as basis for the registration of fishpens and fishcages.

I. Registration Period

The registration period of aquaculture structures shall commence on the first working day of January, until last working day of June of the current year.

II. Scope of Coverage

This Implementing Rules and Regulations/Guidelines shall cover all fishpens and fishcages in the Laguna de Bay and the Seven Crater Lakes.

III. Qualification of Registrants

The prospective registrants shall adhere to the following guidelines as basis for acceptance of their registration papers/documents:

  1. Must have existing and operational structure within the 1996 and 1999 fishpen/fishcage belt, pursuant to the Zoning and Management Plan (ZOMAP), based on the allocated and verified area;

  2. Previously registered and had paid in full the corresponding fishpen/fishcage fee and related charges;

  3. Must have submitted complete set of documentary requirements for registration hereunder identified;

    Duly accomplished and notarized LLDA Application Form;
    1.2
    Latest General Information Sheet (GIS) from SEC;
    1.3
    Business Permit/Mayor’s Permit (Current Year);
    1.4
    Latest Financial Statement (Balance Sheet and Income Statement); and
    1.5
    Certification from the Barangay Captain that the fishpen is located off the waters of the Barangay.

    Fishcages



    2.1
    Duly accomplished LLDA Application Form;
    2.2
    Barangay Clearance; and
    2.3
    Any valid government-issued Identification.

Additionally, delinquent operators shall only be allowed to register, provided that they have paid in full their arrears, penalties or surcharges on or before registration. However, delinquent operators who opt to pay the fishpen arrearages on installment basis, shall comply with the provisions stipulated in Memorandum Circular No. 2015-02 Re: Policy Guidelines on Staggered Payment. Otherwise, they shall no longer be allowed to operate and register an aquaculture structure in the Laguna de Bay and the Seven Crater Lakes and the same shall be subject for demolition.

Furthermore, fishpen located within the so-called, “Cataquiz Belt” shall not be allowed to register pending Resolution of the case filed before the Regional Trial Court Branch # 170 in Malabon City by the fishpen operators under the 2003 fishpen belt.

All Fishpen/Fishcage of Laguna de Bay and Seven Crater Lakes operators who opt to pay in full within the first quarter shall be entitled to a discount rate of 5% as incentive (as per Board Resolution No. 8, Series of 1993).

However, by July of the current year, a surcharge of 2.5% per month shall be imposed pursuant to LLDA Board Resolution No. 450, Series of 2013.

This is without prejudice to the imposition of Administrative Fine of P5,000.00 per violation pursuant to LLDA Board Resolution No. 42, Series of 1996.

b. Mechanism of Payments

  • Only Manager’s checks, Cashier’s check or Cash shall be accepted;
  • Payment shall be made direct to LLDA cashier or through “on line payment” to LLDA Account No. 0712-2220-77 at any Land Bank of the Philippines Branch within the Laguna de Bay Region; and
  • Post dated checks shall not be accepted.

This Circular shall take effect immediately upon publication in a newspaper of general circulation and registration in the Office of the National Administrative Register (ONAR).
