AMENDING DEPARTMENT ORDER NO. 97-1097 TO EXPAND THE SCOPE OF “AIRPORT SHUTTLE SERVICE”, AND PROVIDING AN EXEMPTION TO THE MORATORIUM ON ACCEPTANCE OF APPLICATIONS FOR CERTIFICATES OF PUBLIC CONVENIENCE



On September 29, 1997, this Department issued Department Order No. 97-1097 setting standard classifications for public transport conveyances to be used as a basis for the issuance of Certificates of Public Convenience (CPC) for Public Utility Vehicles.

Due to the lack of transport services available in airport terminals, this Department issued Department Order No. 2012-12, creating the “AIRPORT SHUTTLE SERVICE” and “AIRPORT METERED TAXI” as new modes of public transport.

In view of the need for a means of transport which will ferry airline passengers from the airport to a designated terminal point, and vice versa, there is a need to expand the scope of Airport Shuttle Service.

In view of the foregoing, paragraph 10 of Department Order No. 97-1097 is hereby amended to read as follows:

“10. AIRPORT SHUTTLE SERVICE


Vehicle Type
:
Coaster, coach, mini bus and bus
Route
:
Service between/ among passenger terminal buildings of airports, or from an airport to a designated transfer area, such as city terminals and designated pick up and loading/unloading points.
Ventilation
:
Air-conditioned
Fare
:
As authorized by LTFRB
Operating Conditions
:
a)
Special Service for airline passengers and airport personnel only, who are directly bound for or loading or alighting at air terminals or at designated pick-up and loading/unloading points;


b)
Operators or their duly authorized representatives shall not be allowed to load or unload passengers outside of the loading/ unloading bays located at the passenger terminal building of airports, or the designated transfer area;


c)
Each vehicle must be equipped with a two-way radio;


d)
The side of the vehicle must display “Airport Shuttle Service”;


e)
Drivers must be in uniform and must have company IDs;


f)
Each vehicle must have clear glass windows;


g)
All vehicles must be brand new;


h)
Each vehicle must be equipped with proper tools and equipment;


i)
The operator must have its own garage and repair shop for the proper repair and maintenance of its vehicles;


j)
The operator must have a valid contract with, or be accredited by, the relevant airport authority; and


k)
The operator must comply with rules and regulations issued by government agencies.”

Applications for CPCs for Airport Shuttle Service which serves routes from the airport to designated terminal points may be accepted and processed by the Land Transportation Franchising and Regulatory Board, subject to the issuance of the route measured capacity by this Department.

This Department Order amends and supersedes all issuances inconsistent herewith, and shall take effect immediately, following its publication in a newspaper of general circulation.
