[ ERC RESOLUTION NO. 07, S. 2013, February 18, 2013 ]

A RESOLUTION ADOPTING AND APPROVING ADDENDUM TO AMENDMENT NO. 1 OF THE PHILIPPINE GRID CODE (PGC), ESTABLISHING THE CONNECTION AND OPERATIONAL REQUIREMENTS FOR VARIABLE RENEWABLE ENERGY (VRE) GENERATING FACILITIES



WHEREAS, Republic Act No. 9513, otherwise known as the Renewable Energy Act of 2008 (the “Act”) aims to promote the development, utilization, and commercialization of renewable energy resources. The Act particularly provides for the establishment of the framework for the accelerated development and advancement of renewable energy resources and the development of a strategic program to increase utilization of said resources;

WHEREAS, Section 9.9 of Amendment No. 1 to the Philippine Grid Code (PGC) states, That:

“9.9 Connection Requirements for New and Renewable Energy Sources – The requirements for Generating Plants that utilize non-conventional Equipment for new and renewable energy sources, whose aggregate capacity at the Connection Point exceeds 20 MW; shall be prescribed by the ERC after due notice and hearing.”

WHEREAS, due to the adopted state policies to promote and accelerate the development and utilization of renewable energy resources, it has become desirable that the provisions of the PGC be revised and amended;

WHEREAS, pursuant to its mandate to initiate and coordinate revisions to the PGC and make recommendations to the ERC[1], the Grid Management Committee (GMC) initiated the process of amending the PGC to incorporate therein the connection and operational requirements for identified renewable energy resources;

WHEREAS, on 22 October 2012, the proposed draft amendments to the PGC were posted at the ERC and GMC websites for the solicitation of comments from power industry stakeholders;

WHEREAS, on 28 November 2012, a public consultation was conducted to discuss the said proposed amendments;

WHEREAS, the GMC considered the comments submitted during the public consultation and, after further deliberations, the GMC completed and came out with the final draft of the proposed PGC revisions;

WHEREAS, on 18 February 2013, the GMC submitted the proposed PGC revisions to the ERC for its approval and adoption;

WHEREAS, the ERC has found the proposed PGC revisions to be in order and consistent with the policy of the state to accelerate the development and promotion of emerging renewable resources;

NOW THEREFORE, the ERC hereby RESOLVES to APPROVE and ADOPT the proposed revisions to the PGC entitled “Addendum to Amendment No. 1 of the Philippine Grid Code, Establishing the Connection and Operational Requirements for Variable Renewable Energy (VRE) Generating Facilities”, hereto attached and made an integral part hereof as Annex “A”[*].

This Resolution shall take effect fifteen (15) days after its publication in a newspaper of general circulation.

Let copies of this Resolution be furnished the University of the Philippines Law Center - Office of the National Administrative Register (UPLC-ONAR).
