REVISED RULES ON INSTALLATION OF EARLY WARNING DEVICE (EWD)



Reports have reached this Office that there are motor vehicles involved in road crashes that are not properly equipped with standard EWD in violation of LOI 229. Also, to circumvent the law, some motor vehicle owners resort to borrowing of EWDs belonging to others.

In view thereof, the following rules are hereby promulgated to strengthen enforcement and to protect road users from the ruinous impact of road crashes involving stalled vehicles:

  1. The EWD as mandatory accessory for all motor vehicles, except for motorcycles and tricycles shall, henceforth, be required to be presented during the registration of a motor vehicle.
  2. Serially numbered stickers with alpha numeral shall be attached to newly purchased pair of EWD and another piece of sticker should be affixed to the latest official receipt (OR) of payment of the registered motor vehicle or the serial number found in the EWDs shall be written on the face of the OR. The serially numbered EWD stickers shall be issued by the supplier of EWD.
  3. During the conduct of law enforcement operation, EWDs without the required serial numbers may be acceptable, provided the EWDs are in accordance with the prescribed specifications.
  4. Vehicle owners/operators who fail to comply with the rules on carrying and installation of EWD shall be subject to penalties under the existing LTO rules and regulations.
  5. All EWDs must conform with the following specifications:
    1. Dimension and Material. Each of the pair is triangular, collapsible, made of reflectorized plates, the sides of which are at least 40 cms. long and 5 cms. wide.
    2. Quality of Visibility. The triangles must be visible even in adverse weather conditions at a distance of at least 400 meters at high beam. These must lean slightly backwards, 5 to 10 degrees from the axis, perpendicular to the roadway, in order to provide maximum visibility from its reflectorized sides.
  6. The EWD must be installed at least four (4) meters to the front and at the rear of a motor vehicle whenever a motor vehicle is stationary for any reason, or it is compelled to stop on an area where standing or parking is prohibited.
  7. All previous memoranda and other issuances in conflict herewith are deemed superseded.
