NON-CONFIRMATION FOR UNITS OF DISMISSED APPLICATIONS WITH PRAYER FOR EXTENSION OF VALIDITY

The Board issued Memorandum Circular No. 2011-004 (Re: 2011 Revised Terms and Conditions of CPC and Providing Penalties for Violation Thereof), pertinent provision of which reads:

Sec. 36. The PUV operator shall seek confirmation of his/her/its franchise with the Board prior to registration of the authorized unit/s with the Land Transportation Office. Failure to confirm for two (2) consecutive years shall result in the cancellation of franchise.”

Records of the Board showed that there are substantial number of applications which were dismissed for lack of interest of the operators to pursue the same. The units authorized therein can still be confirmed when a Motion for Reconsideration is filed.

In light of the above considerations, the Board hereby decrees that unit/s under a dismissed application with prayer for extension of validity shall not be allowed confirmation for the purpose of registration until the said dismissal is lifted and set aside pursuant to Section 33 of the Public Service Law.

This Memorandum Circular shall take effect fifteen (15) days following its publication in at least one newspaper of general circulation. Let three (3) copies hereof be filed with the UP Law Center pursuant to Presidential Memorandum Circular No. 11, dated 09 October 1992.
