[ CAB RESOLUTION NO. 50 (BM 5-07-26-2013), July 22, 2013 ]

REVISED FEES AND CHARGES OF THE CIVIL AERONAUTICS BOARD WITH CORRESPONDING AMOUNT OF ONE PER CENTUM (1%) LEGAL RESEARCH FEE



WHEREAS, on 05 February 2013, the Department of Finance (DOF), Department of Budget and Management (DBM) and National Economic Development Authority (NEDA) enacted DOF-DBM-NEDA Joint Circular No. 1-2013, which provides for the rules and regulations to implement and monitor compliance with Administrative Order no. 31 (2012) of the Office of the President (OP);

WHEREAS, OP-Administrative Order no. 31 (2012) directs and authorizes all heads of Departments, Bureaus, Commissions, Agencies and Offices and Instrumentalities of the National Government, including Government-Owned and/ or Controlled Corporations, to rationalize the rates of their fees and charges, increase their existing rates and impose new fees and charges;

WHEREAS, Joint Circular No. 1-2013 provides that:

“3. SCOPE

This Circular shall apply to all national government departments, bureaus, commissions, agencies, offices and instrumentalities of the National Government, including GOCCs rendering services to the public for a fee or charge to cover the cost of services rendered, except those fees which are:

  1. Processed by regulatory agencies in the exercise of their mandate pursuant to their charter to regulate the schedule of charges, tariffs or fares imposed by the public utility companies or operators, such as those in the transport, water, power and telecommunication sectors;

WHEREAS, the CAB, under Republic Act no. 776, has the authority to revise its rates of fees and charges necessary for the use of the civil services it renders in processing applications and registration of the air carriers’ permits, licenses, among others, as provided under Section 50 and 51 thereof;

WHEREAS, the Civil Aeronautics Board (CAB) takes exception to Joint Circular No. 1-2013 as the fees and charges it imposes fall outside of the scope as expressed therein;

WHEREAS, moreover, the CAB recognized the need to adjust the administrative fees and charges to cope with the rising costs of operating expenses as indicated by increases in the consumer price index and the inflation rate since the last increase in 2001;

WHEREAS, since the CAB last revised its fees on 09 November 2000, with a corresponding additional Legal Research Fee (LRF) by virtue of Letter of Instructions No. 1182 (1981) on February 2001 and the delivery of services to the people entails cost to the government with equity requiring that persons receiving or benefiting from rendered services share the cost of providing such services, the CAB proposed to revise its fees and charges by incorporating a 20% increase in the current fees and charges, except for the three (3) classifications for which it proposed to impose 50%, 67% and 200% increases;

WHEREAS, the fees and charges of the CAB with corresponding amount of one per centum (1%) Legal Research Fee (LRF), as revised, are as follows: (see NAR Volume 25 No. 1, January-March 2014, pp. 135-140)

NOW, THEREFORE, in view of the foregoing, the Board RESOLVED, as it hereby RESOLVES, to APPROVE the Revised Fees and Charges of the CAB with the corresponding amount of one per centum (1%) Legal Research Fee (LRF). This resolution shall effectively amend CAB Resolution No. 117 (2000) and shall take effect immediately.
