AN ORDINANCE GOVERNING THE HANDLING, DISPOSITION AND UTILIZATION OF THE PHILIPPINE AMUSEMENT AND GAMING CORPORATION TRUST FUND ACCOUNG REMITTED AS FINANCIAL ASSISTANCE TO THE CITY OF MANILA AS HOST CITY, AND FOR OTHER PURPOSES

PREAMBLE

WHEREAS, the Philippine Amusement and Gaming Corporation (PAGCOR) is operating a number of casinos in the City of Manila;

WHEREAS, as PAGCOR's way fo sharing its income to its host city, monthly amount is being remitted to the City of Manila with the end view of helping strengthen the capacity of the city to address various pressing socio-economic concerns and provided basic services and vital facilities;

WHEREAS, on October 20, 2015, the PAGCOR's Board of Directors approved the revised guidelines, which provide, among others, the projects to be financed and the amount of funding required should be jointly approved by the City Mayor and the City Council through the corresponding appropriate ordinance;

WHEREAS, the revised guidelines will help ensure transparency and accountability on the utilization of the fund for its intended purposes: NOW, THEREFORE,

Be it ordained by the City Council of Manila, in session assembled, THAT:

SECTION 1. Title. – This Ordinance shall govern the handling, disposition and utilization of the host city share remitted by the Philippines Amusement and Gaming Corporation (PAGCOR) to the City of Manila.

SEC. 2. The funds shall only be utilized for the following qualified projects as provided for under the guidelines of the PAGCOR, to wit:
  1. Self-sustainable livelihood projects preferably at the grassroots level to provide employment and generate income for the less fortune segments of the community, including the physically challenged, the elderly citizens, orphaned and abandoned youth.  Whenever possible, these project should utilize indigenous materials.  This category also includes home-project such as soap-making, meat processing and the like, for the formation and improvement of skills and takents that will enhance the income earning potential of the individual, particularly the poor and the physically challenged;

  2. Scholarships to include high-impact short courses such as Computer Science, Tailoring, Auto Mechanic and other Vocatonal Subject;

  3. Infrastructure project which are essential to the community;

  4. Project connected with the delivery of basic health services, including the improvement of the facilities and the acquisition of needed equipment for the hospitals, clinics and health center of the city.  Other projects designed to prevent widespread diseases of epidemic such as mass vaccination, declogging and recollection of grabage ad debris in sewers and canals, construction of sanitary facilities in depressed areas, and the like;

  5. Project which have to do with the improvement of peace and order in the City;

  6. Projects which involve the extension of emergency assistance to victims of natural disasters and other calamities and terrorism; and

  7. Such other projects that will help alleviate poverty within and among the poor sector.
SEC. 3. The city shall comply with the following requirements or conditions:
  1. The fund shall be kept in a separate account and shall not be comingled with the general and other funds of the City;

  2. The projects to be financed and the amount of funding required shall be jointly approved by the City Mayor and the City Council through the corresponding appropriate ordinance;

  3. The funds shall not be utilized for salaries and wages of City Government personnel;

  4. Disbursement of funds shall be subject to the requirements and procedures of the Commission on Audit (COA); and

  5. Submission to PAGCOR by the Office of the Governor/City Mayor of a COA certified Utilization Reporst on a quartly basis and other reports which PAGCOR may require.
SEC. 4. The Honorable Mayor is hereby designated as the administor of the Trust Fund.  In compliance with Section 3 (b) hereof, the Mayor shall submit all proposed projects to be finance from the PAGCOR Trust Fund for approval of the City Council, through a resolution duly issued for the purpose.

SEC. 5. Separibilty Clause. – If any reason or reasons, amy part or provision of this Ordinance shall be held to be unconstitutional or invalid, others parts or provision hereof, which are not affected thereby, shall continue to be in full force and effect.

SEC. 6. Effectivity. – This Ordinance shall take effect immediately upon its approval.
