EXEMPTION FROM PORT CHARGES OF VESSELS DRYDOCKED/REPAIRED AT AUTHORIZED SHIPYARD FACILITIES



In order to encourage the growth of the shipyard industry through drydocking/repairs of vessels, the following guidelines are hereby promulgated:

SECTION 1. Definition of Terms. — For purposes of this Order the following terms shall have the following meaning:

a. Vessel for Drydocking — This refers to vessel or watercraft intending to undergo drydocking/repair as required by the Classification Society or other government agencies.

b. Vessel — Refers to every sort of boat, craft or other artificial contrivance used, or capable of being used as means of transportation on water.

c. Port charges — Refer to harbor fees, anchorage fees, berthing fees, usage fees and lay-up fees assessed on the vessel.

d. Dry or graving dock — An artificial basin of elongated form opening off a harbor or waterway, fitted to receive vessels, with mechanism to control water level, for the purpose of painting or hull/bottom repair of vessels.

e. Dock — Artificial basin or inclosure connected with a harbor or river of considerable range of tide, provided with lock gates in order to retain a depth of water undisturbed by entering or departing vessels.

f. Authorized shipyard repair/Operator — Refers to a shipyard operator owner or ship repair facilities which has been given recognition/accreditation/permit and has registered with the Maritime Industry Authority.

SECTION 2. Exemption from Port Charges. — A vessel which is drydocked/repaired at any of the authorized drydocking shipyard facilities shall be exempted from port charges from the time it calls at the shipyard facilities up to the time the repair is completed and the vessel has departed.

SECTION 3. Requirements for Drydocking/Repair. — In order that vessels can avail of exemption from port charges, the following requirements shall be complied with:

a. The shipyard operator shall submit to PPA, in advance, a list of vessels scheduled for drydocking and repair.

b. Vessels for drydocking, whether foreign or domestic shall present Notice of Arrival/Application for Berth to the PPA.

c. Vessels are actually drydocked at authorized shipyard for repairs.

d. In addition, the shipyard operator shall issue drydocking certificate to the vessel and same shall be presented to the PMO/Terminal Office as a requisite for departure clearance. The certificate shall contain, among others, the actual stay of vessels in the shipyard premises and/or at the drydock facility and a description of the repairs made.

SECTION 5. PPA Clearance. — Vessel leaving the drydocking/repair facilities shall secure the necessary clearance from the Port Management Office, in addition to other clearances required by other government agencies.

SECTION 6. Repealing Clause. — All PPA rules, regulations, orders, memoranda, circulars or parts thereof which are inconsistent with this order, are hereby repealed or modified accordingly.

SECTION 7. Effectivity. — This Order shall take effect 15 days after publication in the official gazette of newspaper of general circulation.
