(NAR) VOL. II NO. 4 / OCTOBER - DECEMBER 1991

[ BFAD FDA MEMORANDUM CIRCULAR 001 s. 1983, March 10, 1983 ]

REQUIRING RETAILERS TO PROCURE STOCKS FROM LEGITIMATE DISTRIBUTORS

In order to prevent the sale and distribution of substandard drugs in the domestic market, it is hereby directed that all drugstores, hospital pharmacies, wholesalers, and other retailers of drugs and medicines must procure or buy their stocks only and only from legitimate or authorized manufacturers or distributors.

All transactions covering purchase of drugs and medicines must be accompanied by a sales invoice, indicating therein among others, the lot or batch no. of the manufacturer's stocks.

All concerned are therefore WARNED accordingly. Any stocks procured from illegitimate or unauthorized sources, are deemed violative and not approved by the FDA and therefore subject to outright seizure or confiscation as mandated by LOI No. 1223 dated April 12, 1982 of the President of the Philippines. FDA may take such further administrative and legal actions including but not limited to the prosecution of the owner, pharmacist, and others concerned as well as the closure of the drug establishment.

For strict compliance.
