[ SAN JUAN CITY ORDINANCE NO. 75 Series of 2015, October 12, 2015 ]

OFFICE OF THE SANGGUNIANG PANLUNGSOD

AN ORDINANCE REQUIRING ALL BUSINESS ESTABLISHMENTS WITH LESS THAN FIFTY (50) BUT MORE THAN FIFTEEN (15) EMPLOYEES OR OCCUPANTS IN THE CITY OF SAN JUAN TO UNDERGO A FIRE SAFETY SEMINAR, TO CONDUCT FIRE AND EXIT DRILLS AND ORGANIZE FIRE BRIGADES TO BE FACILITATED BY THE BUREAU OF FIRE PROTECTION OF SAN JUAN CITY AT LEAST ONCE A YEAR AND PROVIDING PENALTIES FOR NON-COMPLIANCE THEREOF.

NOW THEREFORE BE IT ORDAINED
by the Sangguniang Panlungsod of the City of San Juan, Metro Manila in a session duly assembled, that:

Section 1. All business establishments having less than fifty (50) but more than fifteen (15) employees or occupants shall be required to undergo a Fire Safety Seminar, conduct Fire and Exit Drill and organize Fire Brigades among the employees;

Section 2. The Fire Safety Seminar and the Fire and Exit Drill shall be conducted at least once a year and that the organized Fire Brigade and its elements shall be in existence within the same period;

Section 3. Those with fifteen (15) and below employees shall be required to send one (1) representative for every five (5) employees and in case of less than five (5) employees, at least one shall be sent to attend one (1) hour Fire Safety Seminar to be held at the San Juan Central Fire Station on a twice a day schedule;

Section 4. The Fire Safety Seminar, Fire and Exit Drill and an Organized Fire Brigade for those with above fifteen (15) and less than fifty (50) employees or occupants shall be a requirement for the issuance of a Fire Safety Inspection Certificate (FSIC) for the ensuing business year and that those with fifteen and below employees or occupants shall be required to send their corresponding number of representatives to attend only the Fire Safety Seminar prior to the issuance of the FSIC for Business Permit

Section 5. All business establishments with employees being required to undergo a Fire Safety Seminar shall be required to pay a fee to the Local Treasurer's Office for a minimum amount of Two Hundred Pesos (P200.00) only. Public institutions such as schools, church, and home for charitable outreach are hereby exempted from paying the said fee;

Section 6. The Bureau of Fire Protection (BFP) shall confer a Certificate of Completion to business establishments that have complied with the Fire Safety Seminar requirement under this Ordinance;

Section 7. Those who have not attended the seminar during the previous year shall be required to attend as representatives of the following year to ensure that all employees working in the city shall be covered by the fire safety program of the BFP and shall be in rotation as years pass by in order to update them on the current trends in fire safety;

Section 8. The owner of business establishments shall be held responsible for non-compliance with this Ordinance. Violation of any provision of this Ordinance shall be penalized as follows:

1st Offense  Written Warning
2nd Offense Fine of P3,000.00
3rd Offense Fine of P5,000.00 and/or closure of business establishment or non-renewal of business permit
Section 9. The Bureau of Fire Protection (BFP) of San Juan City shall be the only agency to be tasked to implement and enforce this Ordinance.  The said office shall ' provide an annual report to the Office of the City Mayor and the Office of the Sangguniang Panlungsod, through the Office of the Secretary in relation to the implementation of this Ordinance.

Section 10. A copy of this Ordinance shall be furnished the City Planning Office, City Engineering Office, Business Permit and License Office, the San Juan Philippine National Police, San Juan Bureau of Fire Protection, Public Information Department, the San Juan Chamber of Commerce, all owners of business establishment.

Section 11. This Ordinance shall take effect two (2) months following its approval and publication.
