SANGGUNIANG PANLUNGSOD

** Excerpts from the minutes of the 8th Special Session of the 6th City Council of Valenzuela held on October 13, 2015 at 2:54 P.M. at the City Council's Session Hall, 3rd Floor, Legislative Building, Valenzuela City Hall, Karuhatan, Valenzuela City, Metropolitan Manila.

AN ORDINANCE AMENDING ORDINANCE NO. 77 SERIES OF 2010 REQUIRING ALL EXISTING/NEW BUSINESS AND OCCUPATIONAL UNDERTAKINGS WHO HAVE REGISTERED/WILL REGISTER TO SECURE A BUSINESS AND PERMIT REGISTRATION PLATE UPON RENEWAL/SECURING BUSINESS AND APPROPRIATING THE SUM OF NINE HUNDRED SEVENTY FIVE THOUSAND (P975,000.00) PESOS FOR THE PURPOSE.

WHEREAS, Republic Act 7160, otherwise known as the "Local Government Code of 1991" has empowered each local government unit to create its own sources of revenue and to levy taxes, fees and charges subject to the provisions of herein, consistent with the basic policy of local autonomy;

WHEREAS, Ordinance No. 33 Series of 1993 was enacted by then Sangguniang Bayan of Valenzuela in pursuant to the power, duties and functions as the legislative body of then Municipal Government of Valenzuela;

WHEREAS, since the creation of Valenzuela Anti-Drug Abuse Council (VADAC) in 2001 and until now there were new existing programs and projects to fight the proliferation of illegal drugs in the City of Valenzuela;

WHEREAS, the Valenzuela Anti-Drug Abuse Council provides an effective mechanism for the coordination of existing services and programs called Five (5) keys strategies and actions which is very effective in fighting illegal drugs;

WHEREAS, Five (5) keys of strategies and actions are Public Information, Education, Alternatives, Intervention and Social policies.

WHEREAS, this mechanism formulated by the Valenzuela Anti-Drug Abuse Council needs additional financial support to achieve VADAC's optimum goal of eradicating illegal drugs in the City of Valenzuela.

NOW THEREFORE, be it ORDAINED as it is hereby ORDAINED by the Sangguniang Panlungsod of Valenzuela, in session duly assembled that:

SECTION 1. No. 5 of Section 3 of Municipal Ordinance No. 33, Series of 1993 as amended by City Ordinance No. 77, Series of 2010 is hereby modified and further amended to read as follows:

  a. The cost of the Business Permit Registration Plate and the yearly printed stickers shall be paid at cost by the permitee/licensee. The various cost are as follows:
    for Big Scale Business .................. P300.00
    for Small Scale Business................ P150.00
  b. Validation Stickers................................. P150.00

SECTION 2. Section 5 of the same Ordinance is hereby amended to read as follows:

The income collection from the aforesaid Ordinance will be set aside to finance and support the Preventive Education, Trainings, Information Dissemination and Rehabilitation Program of the Valenzuela Anti-Drug Abuse Council of the City Government of Valenzuela.

SECTION 3. Separability Clause. If, for any reason, any section or provision of this Ordinance or any part thereof, or the application of such section, provision or portion is declared invalid or unconstitutional, the remainder thereof shall not be affected by such declaration.

SECTION 4. Repealing Clause. All ordinances and resolutions or parts thereof inconsistent with the provisions of this Ordinance are hereby repealed or modified accordingly.

SECTION 5. Effectivity. This Ordinance shall take effect Fifteen (15) days after its publication in a newspaper of general circulation.
