AN ORDINANCE AMENDING ORDINANCE NO 222, SERIES OF 2015 ENTITLED, "AN ORDINANCE AUTHORIZING THE CITY MAYOR OF VALENZUELA CITY TO SELL BUILDING OR BUILDING IMPROVEMETS ACQUIRED BY THE CITY GOVERNMENT THROUGH PUBLIC AUCTION OF DELINQUENT REAL PROPERTIES," TO INCLUDE MACHINERIES ACQUIRED BY THE CITY GOVERNMENT THROUGH PUBLIC AUCTION OF DELINQUENT REAL PROPERTIES WITHIN THE COVERAGE OF SAID ORDINANCE.

<B>WHEREAS,</B> the Sangguniang Panlungsod ng Valenzuela enacted Ordinance NO. 222, Series of 2015 – AN ORDINANCE AUTHORIZING THE CITY MAYOR OF VALENZUELA CITY TO SELL BUILDING OR BUILDING IMRPOVEMENTS ACQUIRED BY THE CITY GOVERNMENT THROUGH PUBLIC AUCTION OF DELINQUENT REAL PROPERTIES;

<B>WHEREAS,</B> the scope of said Ordinance was only limited to Building or Building Improvements acquired by the City Government through public auction of delinquent real properties;

<B>WHEREAS,</B> the City Government had determined that apart from the building or building improvements which are the subject matter of Ordinance No. 222, Series of 2015, the City had also acquired several Machineries that it has no viable or feasible use relative to the purposes and services by the City Government to its constituents;

<B>WHEREAS,</B> on these premises, the City Government deemed it necessary and practical to include within the coverage of Ordinance No. 222, Series of 2015 Machineries acquired by the City Government through public auction of delinquent real properties and allow such former registered owners of Machineries or the owners of the lots on which these properties are attached to repurchase/purchase the same from the City Government.

<B>NOW, THEREFORE,</B> be it <B>ORDAINED</B> as it is hereby <B>ORDAINED</B> by the Sangguniang Panlungsod of Valenzuela, in a Session duly assembled, that:

<I><B>SECTION 1</B>. Section 1, 2 and 3 of Ordinance No, 222, Series of 2015 is hereby amended to read as follows:

<B>"SECTION 1. AUTHORITY.</B> The City Mayor is hereby granted the authority to sell building or building improvements and Machineries previously acquired by the City Government in the public auction of delinquent real properties to the respective former registered owners or their successors-in-interest of said building or building improvement or Machineries or in case of failure or unwillingness of the latter, to the registered owners or their successors-in-interest of lots on which these building or building improvements or Machineries are situated or attached, provided that they are updated in the payment of real properties taxes on said lots;

<B>SECTION 2. SCOPE.</B> The Building and Building Improvements and Machineries covered by this Ordinance shall be:

<table width="100%"  border="0" cellspacing="0" cellpadding="2"> <tr valign="top"> <td width="5%">&nbsp;</td> <td width="5%"><i>a.)</i></td> <td width="90%" align="justify"><I>Those building and/or building improvements or Machineries other than lots acquired by the City Government in the public auction of delinquent real properties pursuant to Section 263 of the Local Government Code of 1991 up to the year 2012; and</I></td> </tr> <tr valign="top"> <td>&nbsp;</td> <td>&nbsp;</td> <td align="justify">&nbsp;</td> </tr> <tr valign="top"> <td>&nbsp;</td> <td><i>b.)</i></td> <td align="justify"><I> Those building and/or building improvements or Machineries that remain unutilized or which the City Government had no viable or feasible use.</I></td> </tr> </table>

<B>SECTION 3. CONSIDERATION OR PRICE.</B> As consideration or price of sale, the City Mayor  shall requite from the former registered owners or successors-in-interest of building or building improvements or Machineries or from the registered owners or successors-in-interest of lots on which the subject building or building improvements or Machineries are situated or attached, as the case maybe, the payment of an amount equivalent to the purchase price by which the City Government had previously acquired the building or building improvements or Machineries at the public auction sale plus the corresponding real property tax and interest of 2% per month on the purchase price for one (1) year corresponding to the statutory redemption period." </I>

<B>SECTION 2. SEPARABILITY CLAUSE.</B> If for any reason, a part of this Ordinance is declared illegal or invalid, other parts or provisions hereof which are not affected thereby shall remain valid and in full force and effect.

<B>SECTION 3. REPEALING CLAUSE.</B> All previous Ordinances rules/regulations inconsistent with the provisions hereof are deemed repealed or modified accordingly.

<B>SECTION 4. EFFECTIVITY CLAUSE.</B> This Ordinance shall take effect fifteen (15) days after its publication in a newspaper of general circulation.
