P.D. 96 - CLARIFICATIONS



Pursuant to the provisions of P.D. 96 "Declaring Unlawful the Use or Attachment of Sirens, Bells, Horns, Whistles, or Similar Gadgets that Emit Exceptionally Loud or Startling Sounds, including Domelights and Other Similar signaling or Flashing Devices on Motor Vehicles and Providing Certain Exceptions Therefor" as implemented under Administrative Order No. 1 Series of 1973, the following clarifications are hereby directed:

1. Permits issued to banks, security agencies for armored vans and escort vehicles and individuals to use sirens and domelights/blinkers and similar gadgets are hereby CANCELLED. Towing trucks and wreckers are allowed to use blue domelights only.

2. Sirens and blinkers in motor vehicles are allowed in motor vehicles designated for official use by the Armed Forces of the Philippines, Philippine National Police, Fire Protection Bureau, National Bureau of Investigation, Land Transportation Office and hospital ambulances.

3. Only two foglights are allowed up front a level or lower than the headlights with maximum of 100 watts power each for use in mountainous and foggy areas. These shall be covered when the vehicle is operating in well lighted areas where visibility is far and wide. Decorative fog lamps may be in a vehicle provided these have no bulbs inside and no live wires and switches are attached with clear and visible marking "FOR DECORATIVE PURPOSES ONLY".

4. Sirens, blinkers and domelights including horns and whistles installed in motor vehicles in violation of PD 96 and implemented by AO # 1 Series of 1973 shall be confiscated and the driver fined the equivalent of P600.00. Owners of vehicles with prohibited gadgets as defined in the above law and implementing regulations are hereby directed to detach these gadgets immediately, otherwise, their vehicles will be subject to apprehension and confiscation of the prohibited items starting October 20, 1994.

5. Strict adherence to the provisions of AO # 1 Series of 1973 is enjoined.
