RESOLUTION APPROVING THE AMENDMENTS IN MMDA REGULATION NO. 12-001 SERIES OF 2012, “ANTI-JAYWALKING IN METROPOLITAN MANILA AND PROVIDING PENALTIES THEREFOR”

WHEREAS, the Metro Manila Council enacted Ordinance No. 1 Series of 1995 entitled “Anti-Jaywalking in Metropolitan Manila and Providing Penalties Therefor”;

WHEREAS, to impose stiffer penalties due to blatant violation of the Ordinance by the pedestrians, the Metro Manila Council passed MMDA Regulation No. 12-001 Series of 2012 entitled “Strictly Implementing Anti- Jaywalking and Further Amending Ordinance No. 1, Series of 1995 Entitled “Anti-Jaywalking in Metropolitan Manila and Providing Penalties Therefor” as Amended by MMDA Regulation No. 99-013, Series of 1999”;

WHEREAS, despite the existence of the footbridges, pedestrian overpasses/ underpasses, the pedestrians intentionally violate the Anti-Jaywalking Ordinance;

WHEREAS, jaywalking along the streets and thoroughfares is the main contributory factor to the traffic problems and road accidents in Metro Manila;

WHEREAS, the Council, in session duly assembled, recognizes the need to strictly implement the Anti-Jaywalking Ordinance and further amend Ordinance No. 1, Series of 1995, as amended by MMDA Regulation No. 12-001 Series of 2012, to ease the traffic congestion and mitigate traffic accidents involving pedestrians in Metro Manila;

NOW, THEREFORE, be it resolved as it hereby resolved, pursuant to Sec. 6 of RA 7924 the MMC approves the amendments in the Anti-Jaywalking fines and penalties, and hereby adopts, that:

SECTION 4. Section 4 is hereby amended to read as follows:

SECTION 4. PENALTY. - Violation of this Regulation shall be penalized by the following fine or penalties:

4.1 Five Hundred Pesos (P500.00) which may be paid outright by the apprehended violator at the place of apprehension and upon issuance of a Pedestrian Violation Receipt (PVR). For this purpose, the apprehended jaywalking violator shall be given seven (7) days from date of apprehension to settle the same at the MMDA Redemption Center, otherwise appropriate legal action shall be filed in court.

4.2 In lieu of paying the Five Hundred Pesos fine, the apprehended violator may provide Community Service for not more than three (3) hours of MMDA estero clean-up.

RESOLVED, FURTHER, that the MMDA is hereby authorized to deputize Anti-Jaywalking Enforcers in Metro Manila LGUs priority to Quezon City, Pasig, Taguig, and Pasay.

RESOLVED, FINALLY, that the MMDA Chairman is authorized to issue Implementing Guidelines and Memorandum Circulars in furtherance of this Resolution.

This Resolution shall take effect fifteen (15) days after publication in two (2) newspapers of general circulation in Metro Manila and submission to the Office of the National Administrative Register (ONAR), UP Law Center.
