DIRECTING ALL LOCAL GOVERNMENT UNITS TO REQUIRE CONTRACTORS OF LOCAL GOVERNMENT PROJECTS TO PROPERLY INFORM THE PUBLIC BEFORE THE COMMENCEMENT OF ROAD PROJECTS

1.0 Background

During the 22nd Cabinet Meeting held last February 5, 2018 in Malacañang Palace, President Rodrigo R. Duterte raised a concern regarding the hazards posed by stalled road projects. The President opined that the public, the Local Chief Executives (LCEs), and the Public Works and Highways Secretary should be properly informed before the commencement of road projects, whether national or local.

2.0 Purpose

The purpose of this Memorandum Circular is to direct all Local Government Units (LGUs) to require contractors of local government projects to properly inform the public before the commencement of road project.

3.0 Scope/Coverage

All Provincial Governors, City and Municipal Mayors, Punong Barangays, DILG Regional Directors, ARMM Regional Governor, and all others concerned.

4.0 Policy Content and Guidelines
4.1 All Local Chief Executives are hereby directed to require contractors of local government projects to properly inform the public before the commencement of any road project.

4.2 Said information may be conveyed using tarpaulins, posters or any form of signages, among other media, that are easily noticeable and recognizable by the public, subject to COA Circular No. 2013-004 dated January 20, 2013 entitled, “Information and Publicity on Programs/Projects/Activities of Government Agencies”.

4.3 All LCEs are also directed to ensure compliance of contractors to safety and protection  measures  to  include  installation  of  proper  warning  signages placed 100 meters and 50 meters, respectively, which shall include lights or reflectors during night time before any road or bridge construction.

4.4 Further, all LCEs are required to ensure that contractors shall coordinate with the local traffic management group or its equivalent unit to guarantee the provision of sufficient manpower complement with appropriate equipage to staff the enforcement and maintenance of safe and orderly traffic within the project site on a 24/7 basis.

4.5 The DILG Regional Offices shall monitor the compliance of their respective LGUs with the above-said guidelines, and submit to the Bureau of Local Government Supervision through blgspcmd@gmail.com a monitoring report using the attached monitoring template, every 15th day after the end of each quarter. The first report shall be submitted not later than April 16, 2018.

4.6 All DILG Regional Directors and the ARMM Regional Governor are hereby directed to cause the immediate and widest dissemination of this Memorandum Circular to concerned local government units within their respective areas of jurisdiction.
5.0 Penal Provisions
Non-compliance with this Memorandum Circular is tantamount to dereliction of duty and shall be dealt with in accordance with applicable Civil Service Rules and Regulations, and other pertinent laws, rules and regulations.
6.0 Repealing Clause

All DILG Memorandum Circulars, directives, orders or other related issuances inconsistent herewith in part or in full, are hereby modified, revoked, or repealed accordingly.

7.0 Effectivity

This Memorandum Circular shall take effect immediately.
