AMENDMENTS TO AIR CARGO AND MAIL SECURITY (AMENDING SECTIONS 5, 7, 9, 11, 12 OF MEMORANDUM CIRCULAR NO. 005-2017 DATED NOVEMBER 10, 2017)

Pursuant to Executive Order 277 as amended by Executive Order 311 designating the Office for Transportation Security (OTS) as the single authority in transportation security, mandated to ensure the implementation of Annex 17 to the Convention on International Civil Aviation and the National Civil Aviation Security Program (NCASP), and Transportation Security Regulation 013-2010 on Air cargo Security for Passenger Commercial Aircraft, a Memorandum Circular amending measures for Air Cargo and Mail Security is hereto established and sustained.

RULE II
RESPONSIBILITY, REGULATED AGENTS AND SCREENING

5.3 Aircraft Operator
5.3.1 Ensures that unknown and high risk cargo, company/courier materials, express parcels, mails, company mails are screened are screened prior loading to aircraft; and,

7.1 High risk cargoes and mails and shall be subjected to two (2) security screening procedures enumerated under Section 11 of this circular, preferably x-ray machine and explosive detection system, when applicable.
SECTION 9. Known and Unknown Cargo

9.1 A consignment may only be classified as known cargo if it originates from a known consignor recognized by a regulated agent or aircraft operator, or through a screening process. Consignments received from non-regulated agents shall therefore be treated as unknown cargo and undergo security screening mentioned in Section 7.14, prior to acceptance for transport.

11.1   Screening shall apply to cargo and mail
11.4  In the absence of bilateral agreement with other Contracting States, all transfer and transit cargo and mail shall be treated as originating cargo and shall undergo security screening.
11.5   All screened cargo and mail shall be properly documented and recorded.

MISCELLANEOUS PROVISIONS

SECTION 14. Construction. This circular shall be liberally construed in order to promote its civil aviation security objectives.

SECTION 15. Reservation. The OTS Administrator shall implement and enforce the rules, enunciated herein and prescribe such other requirements, through a clarifying circular, to meet the constantly evolving challenges in civil aviation security.

SECTION 16. Repeal.
All orders, rules, regulations, and issuances, or parts thereof, which are inconsistent with this circular are hereby repealed or modified accordingly.
 
SECTION 17. Separability. If any provision or sections of this rule are declared null and void by competent authority the other provisions not affected shall remain in full force and effect.

SECTION 18. Effectivity. This circular shall take effect immediately. A copy of this circular shall be deposited with the University of the Philippines Law Center in compliance with the Revised Administrative Code.
