ISSUANCE AND VALIDITY PERIOD OF SPS IMPORT CLEARANCE

In view of the anticipated increased volume of importation of agricultural and fishery commodities as well as feeds and feed ingredients in connection with the Christmas holiday season, please be reminded that the Must Ship Out by Date and validity period of the SPS Import Clearance (SPSIC) shall be strictly enforced as stated in DA Administrative Order No. 9 Series of 2010, Section III Rule F:

F.    Must ship out by date - The SPSIC shall indicate the period for which the actual product/consignment should have left the country of origin, the period of which is reckoned from the date of issuance of the SPS Import Clearance as follows:
•    15 days for live, fresh and chilled fish;
•    45 days for other frozen and other fish and fishery/aquatic products;
•    20 days for fresh and chilled fruits and vegetables;
•    60 days for eggs, milk and dairy products, animal feeds and feed ingredients and other products of animal origin i.e. embryos and semen, frozen fruits and vegetables;
•    60 days for live animals, meats, veterinary drug and products, fertilizers, pesticides and other agricultural chemicals;
•    90 days for veterinary biological products; and
•    60 days for all other products not specified immediately above

The SPSIC shall be valid for the period specified above unless sooner revoked for any valid reasons. An unused SPSIC shall be considered automatically expired/cancelled after its must ship out by date.

A particular consignment of a product shall be loaded at the port of the country of origin on or before the last day of the “Must Ship Out by Date” of the corresponding SPSIC. Only a consignment that is shipped not later than this date shall remain having a valid SPSIC once it arrives at any date in any of the Philippines international ports. Non-compliance shall be subjected to confiscation procedures as provided for under Section VII.

In no case shall the date of loading at the port of the country of origin as specified in the bill of lading be earlier than the date of issuance of the SPSIC, otherwise the consignment shall be subjected to confiscation procedures as provided for under Section Vll.
Starting 1 November 2017, all shipments with expired SPSIC or without valid SPSIC shall be confiscated subject to the provisions indicated in Section VII.
