Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

SECTION 1. Section thirty-eight of Republic Act Num­bered Four hundred nine, as amended by Republic Act Numbered Three thousand five hundred thirty-seven, is further amended to read as follows:

"SEC. 38. The City Fiscal and Assistant City Fiscals.—There shall be in the Office of the City Fiscal one chief to be known as the City Fiscal with the rank, salary and privileges of a judge of the Court of First Instance, an assistant chief to be known as the first assistant city fiscal, three second assistant city fiscals who shall be the chiefs of divisions and fifty-seven assistant fiscals, who shall discharge their duties under the general super­vision of the Secretary of Justice. To be eligible for appointment as City Fiscal, first assistant city fiscal and second assistant city fiscal, one must be a natural born citizen of the Philippines and must have practiced law in the Philippines for a period of not less than ten years or held during a like period an office in the Philippine Government requiring admission to the practice of law as an indispensable requisite. To be eligible for appointment as assistant fiscal one must be a natural born citizen of the Philippines and must have practiced law for at least five years prior to his appoint­ment or held during a like period an office in the Philip­pine Government requiring admission to the practice of law as an indispensable requisite.

"The City Fiscal and his assistants shall receive the salaries hereinafter set forth, which shall be paid by the City of Manila:

"(a) City Fiscal, with the rank, salary and privileges of a judge of the Court of First Instance.

"(b) First assistant city fiscal, eighteen thousand pesos per annum.

"(c) Three second assistant city fiscals who shall be the chiefs of the three divisions, seventeen thousand four hundred pesos per annum each.

"(d) Six assistant fiscals, sixteen thousand eight hundred pesos per annum each.

"(e) Six assistant fiscals, sixteen thousand two hundred pesos per annum each.

"(f) Six assistant fiscals, fifteen thousand six hundred pesos per annum each.

"(g) Six assistant fiscals, fifteen thousand pesos per annum each.

"(h) Six assistant fiscals, fourteen thousand four hun­dred pesos per annum each.

"(i) Six assistant fiscals, thirteen thousand eight hun­dred pesos per annum each.

"(j) Six assistant fiscals, thirteen thousand two hun­dred pesos per annum each.

"(k) Five assistant fiscals, twelve thousand six hun­dred pesos per annum each; Five assistant fiscals, twelve thousand pesos per annum each.

"(l) Five assistant fiscals, eleven thousand four hun­dred pesos per annum each."

SEC. 2. All incumbent fiscals of the City of Manila occupying positions affected by the preceding section at the time of the approval of this Act shall continue to occupy their respective positions and receive the salary increase herein provided without the necessity of any new appointments.

SEC. 3. This Act shall take effect upon its approval.
