[ REPUBLIC ACT NO. 4826, June 18, 1966 ]

AN ACT AUTHORIZING THE FISHERIES COMMISSION TO ESTABLISH AND MAINTAIN A FISH SANCTUARY WITHIN LAGUNA DE BAY IN RIZAL AND LAGUNA PROVINCES, DELINEATING ITS BOUNDARIES, AUTHORIZING THE APPRO­PRIATION OF FUNDS THEREFOR, AND FOR OTHER PURPOSES.



Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

SECTION 1. Authority and Definition of Area.—The Philippine Fisheries Commission is hereby authorized to establish and maintain a fish sanctuary in a suitable site of about five thousand hectares in Laguna de Bay (live per rent of lake area) bounded by the following demarcation lines:
"An area in Laguna de Bay enclosed by a line from Punta, Jalajala Point, in the Municipality of Jalajala, Province of Rizal straight to Bay Islet, in the Municipality of Bay, Province of Laguna, and from Bay Islet to a point at Talim Point in Talim Island, in the Municipality    Binangonan, Province of Rizal, and a line from this point northeastward following the line of a group of islets, Malahi, Pihan and Bunga Islets straight to Nagsabya, Talim Island, in the Municipality of Cardona, Province of Rizal,  and from  Nagsabya  Point to  a point  in Bayugo, in the Municipality of Jalajala, Province of Rizal, and a general coast line two hundred meters along the coast from this point of Barrio Bayugo to Jalajala Point."
SEC. 2. Promulgation  of  Hides  and Regulations.—The Secretary of Agriculture and Natural Resources shall promulgate such rules and regulations not inconsistent with law as may be necessary to carry into effect the purposes of this Act.

SEC. 3. Appropriation.—The sum of three hundred seventy thousand pesos is hereby authorized to be appro­priated, out of any funds in the National Treasury not otherwise appropriated, for the establishment, operation and maintenance of the said fish sanctuary during the fiscal year nineteen hundred and sixty-seven. Thereafter such sums as may be necessary for the same purposes shall be included in the annual General Appropriations Act.

SEC. 4. Penal Provision.—Any person or entity who shall conduct fishing operation or catch fish in any manner within the area described in Section one of this Act or destroy or in any way damage any of the materials, equipment and/or improvements installed therein for purposes of the fish sanctuary shall, upon conviction, be subject to a fine of not more than two hundred pesos or improvement for a term of not more than one month, or both such fine and imprisonment, at the discretion of the court.

SEC. 5. Repeal and separability clause.—All laws, parts of laws, orders, ordinances or regulations in conflict with the provisions of this Act are hereby repealed.

If any provisions of this Act or the application thereof to any person or circumstances is declared invalid, the remainder of this Act shall not be affected by such declaration.

SEC. 6. Effectivity.—This Act shall take effect upon its approval.
