[ IRR of REPUBLIC ACT NO. 11780, March 14, 2023 ]

IMPLEMENTING RULES AND REGULATIONS OF REPUBLIC ACT NO. 11780, ALSO KNOWN AS "PALAWAN STATE UNIVERSITY - COLLEGE OF COMMUNITY RESOURCES DEVELOPMENT (PSU-CCRD) EXTERNAL CAMPUSES ACT"



Pursuant to the powers vested to the Board of Regents by virtue of RA 7818 the following rules and regulations are hereby promulgated for the effective implementation of the provisions of RA 11780.

Rule 1
PRELIMINARY PROVISIONS

Section 1. Short Title. These rules and regulations shall be known and cited as the "Implementing Rules and Regulations of Republic Act 11780" or IRR of the RA 11780,

These rules and regulations shall be known and cited as the "Implementing Rules and Regulations of Republic Act 11780" or IRR of the RA 11780, for brevity.

Section 2. Definitions. Whenever used in this IRR, the following terms shall have the respective meanings hereafter set forth:

Abolish - refers to the termination of the existence of a campus as a consequences of a valid and legal cause.

Administrative Center - refers to the central administrative office of each cluster.

Annual General Appropriations Act (GAA) - refers to an act appropriating funds for the operations of the government out of the funds in the National Treasury of the Philippines. It is presented in the form of budgetary programs and projects for each agency of the government, with the corresponding appropriations for each program and project, including statutory provisions of specific agency or general applicability.

Appointment - refers to an issuance directed to a personnel who meets the qualification requirement of a position which he/she is being appointed to be in a permanent or temporary manner.

Assets - Collective term which refers to all real and personal assets, personnel, and records of PSU CCRD.

Campus - refers to the following:
1. Main Campus - refers to the Palawan State University's Campus located in Tiniguiban Heights, Barangay Tiniguiban, Puerto Princesa City where the administrative services of the University are located and/or where the University President holds office permanently.

2. External Campus/es - refers to a campus outside the Main Campus and referred to as Regular Campuses of the Palawan State University in Section 2 of RA 11780.

3. Regular Campus - refers to the former Palawan State University-College of Community Resources Development (PSU-CCRD) External Campuses in the following municipalities of the Province of Palawan and in the City of Puerto Princesa, namely: PSU-Narra, PSU-Quezon, PSU-Brooke's Point, PSU-Roxas, PSU-Taytay, PSU-Coron, PSU-Sofronio Espanola, PSU-Rizal, PSU-Rizal, PSU-Bataraza, PSU-Balabac, PSU-Dumaran, PSU-San Vicente, PSU-Linacapan, PSU-Araceli, PSU-El Nido, and PSU-San Rafael located in Barangay San Rafael in the City of Puerto Princesa.

The PSU Cuyo Campus (formerly Palawan College of Arts and Trade) in the Municipality of Cuyo which was integrated with the University shall likewise be referred to as PSU PCAT (Cuyo Campus) and to be considered as a Regular Campus of Palawan State University.
Campus Administrator - refers to a former Campus Director who is authorized to manage the administrative and academic operations of the Campus. He/She is also tasked to formulate and implement the plans, programs, projects, and activities of the Campus, in accordance with the overall vision, mission, goals, and objectives of Palawan State University.

CCRD - refers to the College of Community Resources Development (PSU-CCRD).

Designation - refers to a movement that involves an imposition of additional and/or higher duties to be performed, by a personnel, which is temporary and can be terminated anytime at the pleasure of the appointing officer/authority.

Federated Alumni Association - an alumni association in a multi-campus university, in which the duly elected Alumni Federation President/Chair/Head represents its sector in the Board of Regents (BOR).

Federated Faculty Association/Faculty Union - a faculty association/union in a multi-campus SUC in which the duly elected Faculty Federation President represents its sector in the Board of Regents (BOR).

Federated Supreme Student Council (SSC)/ Student Government (SG) - a student organization applicable in SUCs that have more than one campus, in which the duly elected Student Federation President represents their sector in the Board of Regents (BOR).

Financial Support - aid in support of the University in the form of money to defray the additional operating expenses.

Governance - refers to the act of carrying out the powers and duties vested to the Governing Board as provided in Section 17 of the 2022 Revised Implementing Rules and Regulations of the Higher Education Modernization Act of 1997.

Governing Board - refers to the Palawan State University Board of Regents.

Governing Charter - refers to Republic Act No. 7818 or the Act Converting the Palawan State University into a State University to be known as the Palawan State University and Republic Act No. 11780 or the Palawan State University-College of Community Resources Development (PSU-CCRD) External Campuses Act.

Graduate Programs - refer to higher education programs leading to a certificate, diploma, master's, or doctorate degree, as may be authorized and recognized by the CHED.

Head of the University - refers to the President of Palawan State University who exercises overall supervision and management of the university.

Implementing Rules and Regulations (IRR) - refers to Implementing Rules and Regulations of this law (RA 11780).

Multi-campus - refers to a university which is composed of two or more campuses.

NBC461 - also known as the National Budget Circular No. 461 which is an issuance by the Department of Budget and Management revising and updating the compensation and position classification plan for faculty positions embodied in national compensation circular (NCC) No. 69. Its purpose is to prescribe rules and regulations governing the implementation of the Revised Compensation and Position Classification Plan for faculty positions in SUCs, HEIs and TEIs in accordance with the modified Common Criteria for Evaluation (CCE) of faculty positions.

Personnel - Collective terms which refers to executive officials, officers, faculty members, and non-teaching personnel of the University, regular, casual, contract of service, or job order.

Research and Extension Services - refers to a function of the Palawan State University and its personnel directed to the development, transfer, utilization and commercialization and protections of new knowledge, technologies, methods, procedures, intellectual properties and scholarly works necessary for continuing improvement in the capacity of Palawan State University in the realization of its legal mandates, vision, mission, goals and objectives.

Reversion - refers to the return to the local government unit of a parcel of land transferred in favor of the university that is originally belonging to the local government unit concerned.

Rights of Personnel - Collective term which refers to the rights of executive officials, officers, faculty members, and non-teaching personnel of PSU over employment positions and security of tenure, if applicable, under existing laws prior to conversion into a regular campus.

ROSSS - The Revised Organizational Structure and Staffing Standards for State Universities and Colleges (SUCs).

Short-Term Technical-Vocational Courses - refers to the education or training process where it involves, in addition to general education, the study of technologies and related sciences and acquisition of practical skills relating to occupations in various sectors of economic life and social life, comprises formal (organized programs as part of the school system) and non-formal approaches which may lead to a Baccalaureate Degree.

Undergraduate Programs - refer to any program leading to a degree, as may be authorized and recognized by the CHED.

University - refers to Palawan State University or PSU.

Section 3. Scope and Application of the IRR.

This IRR covers all the regular campuses of Palawan State University in the Province of Palawan and in the City of Puerto Princesa.

Rule II
MANDATE

Section. Curricular Offerings.

The regular campuses in the Province of Palawan and in the City of Puerto Princesa shall provide graduate, undergraduate, and short-term technical-vocational courses within its competency and areas of specialization pursuant to its mandate and according to its capabilities, as the Board of Regents may deem necessary to carry out its objectives, and those which respond to the human resource development needs of the Province of Palawan and the Mindoro, Marinduque, Romblon, and Palawan (MIMAROPA) Region (Section 3 of R.A. 11780).

Section 2. Research and Extension Services.

The campuses in the Province of Palawan and in the City of Puerto Princesa are mandated to undertake research and extension services, and to provide progressive leadership in these areas.

Rule III
GOVERNANCE AND ADMINISTRATION

Section 1. Governance.

The governance of the university shall be vested exclusively in the Board of Regents, hereinafter referred to as the Board.

Section 2. The University President.

The University President shall exercise overall supervision and management of the campuses.

Section 3. The Vice President for Academic Affairs

The Vice President for Academic Affairs shall appointed/designated by the University President subject to confirmation by the Board of Regents. As head of the Academic Affairs Division, he/she shall be directly responsible to the President for carrying out the educational policies and programs of the University and in supervising curricular, instructional, and other academic activities of the University.

Section 4. The Vice President for Finance and Administration

As head of the Financial Management Division and Administration, he shall be responsible for all University financial matters and shall be directly responsible for the administrative operations of the University.

Section 5. The Vice President for Research and Extension

The Vice President for Research and Extension shall be appointed/designated by the University President subject to confirmation of the Board of Regents. As head of the Research and Extension Division, he shall be directly responsible for all the research and extension programs of the University.

Rule IV
HEADS OF EXTERNAL CAMPUSES, QUALIFICATIONS
SELECTION AND APPOINTMENT, AND OTHER RELATED MATTERS

Section 1. Campus Administrator

Each regular campus shall be headed by a Campus Administrator who shall render full-time service and be appointed or designated by the Board, upon the recommendation of the President, subject to the guidelines, qualifications, and standards set by the Board.

Rule V
ASSETS, LIABILITIES, AND PERSONNEL

Section 1. Transfer of All Assets, Personnel, Records, and Liabilities to the University.

a. All assets, real or personal, personnel and records of PSU-CCRD External Campuses located in the municipalities of Narra, Quezon, Brooke's Point, Roxas, Taytay, Coron, Sofronio Española, Rizal, Bataraza, Balabac, Dumaran, San Vicente, Linapacan, Araceli, El Nido, Cuyo and in the City of Puerto Princesa (San Rafael and Manalo) as well as liabilities or obligations, are hereby transferred and shall be titled in favor of the University.

Section 2. Transfer of Parcel of Lands Occupied by Campuses.

All parcels of land belonging to the government occupied by the PSU-CCRD External Campuses in the Province of Palawan and in the City of Puerto Princesa are hereby transferred to the University, and shall be titled under its name: Provided, that should the campuses or the University cease to exist or be abolished, or should such aforementioned parcels of land be no longer needed by the University, the same shall revert to the local government units concerned.

Section 3. Upgrade or Increase of Human Resource Component.

Platilla positions necessary for proper and efficient administration of each campus and for proper implementation of RA 11780 shall be opened subject to Civil Service laws, rules and regulations.

Rule VI
APPROPRIATION AND FINANCIAL MANAGEMENT

Section 1. Appropriations.

The amount necessary to carry out the provisions of RA 11780 and the operations of the campuses shall be sourced from the Annual General Appropriations Act (GAA) and the income generated by the University.

Section 2. Budget.

Each campus shall prepare ad propose its own budget which shall be consolidated and approved by the Board before the year of implementation.

Rule VII
MISCELLANEOUS AND TRANSITORY PROVISIONS

Section 1. Hold-over Capacity of Incumbent Campus Directors.

The incumbent Campus Directors of the existing campuses of Palawan State University shall continue to serve as such until new Campus Administrators shall have been appointed or designated.

Section 2. Positions, Rights, and Security of Tenure of Existing Personnel.

The positions, rights, and security of tenure of faculty members and personnel therein employed under exiting law s prior to their conversion into regular campuses shall be respected: Provided, that the incumbents occupying the positions shall remain in the same status until otherwise provided by the Board.

Section 3. Clustering.

As part of the transition to a Regular Campus, the CCRD campuses shall be grouped into six (6) Clusters:
(1) PSU-Del Sur Cluster which shall be composed of Brooke's Point, Bataraza, Balabac and Espanola;

(2) PSU-Occidental Cluster which shall be composed of Narra, Quezon, and Rizal campuses;

(3) PSU-Oriental Cluster which shall be composed of Roxas, San Vicente, Araceli, and Dumaran campuses;

(4) PSU-Del Norte Cluster which shall be composed of El Nido, Coron, Linapacan, and Taytay campuses;

(5) PSU-PCAT Cuyo Campus;

(6) Puerto Princesa Cluster which shall be composed of Tiniguiban (Main Campus), Manalo and San Rafael campuses.
Each Cluster, except Cluster 6, shall be headed by a Cluster Dean, The Cluster Deans shall report directly to the Vice President for Academic Affairs (VPAA).

On financial and administrative matters, the Cluster Deans shall report to the Vice President for Research and Extension.

Each cluster shall have an Administrative Center located in the following, thus,
(1) PSU-Del Sur Cluster - Bataraza Campus;

(2) PSU-Occidental Cluster - Quezon Campus;

(3) PSu-Oriental Clsuter - Roxas Campus;

(4) PSU-Del Norte Cluster - El Nido Campus;

(5) PSU-PCAT Cuyo Campus.
Section 4. Federation of Alumni Association, Supreme Student Council, Faculty Association, and Hold Over Capacity of Incumbent Presidents of the PSU Faculty Association, Supreme Student Council, Alumni Association

Upon the effectivity of this IRR, the PSU Faculty Association, Duly Recognized Alumni Association and Supreme Student Council.Student Government shall cause their federation, pursuant to the 2022 Revised IRR of RA 8292 "The Higher Education Modernization Act of 1997". The incumbent presidents of the faculty association, supreme student council and alumni association, sitting as members of the Board, shall remain in the same status until a new president of their respective federated organizations shall have been duly elected.

Section 5. Financial Support by the Local Government Units.

The municipalities of Narra, Quezon, Brooke's Point, Roxas, Taytay, Coron, Sofronio Española, Rizal, Bataraza, Balabac, Dumaran, San Vicente, Linapacan, Araceli, El Nido, Cuyo and the City of Puerto Princesa shall provide the same financial support to the respective campuses the amount necessary for the continued operation and maintenance of the campuses.

Rule VIII
SUPPLETORY APPLICATION

Section 1. Integral Part of the Governing Charter.

The provisions of Republic Act No. 8292, otherwise known as the "Higher Education Modernization Act of 1997", and Republic Act No.s 7818 and CMO No. 7 series of 2022 shall form an integral part of RA 11780, and shall serve as part of the governing charter of the University.

Rule IX
SEPARABILITY AND REPEALING CLAUSE

Section 1. Separability Clause.

If any part of this IRR is declared unconstitutional or invalid, the other parts or provisions hereof not affected thereby shall remain to be in full force and effect.

Section 2. Repealing Clause.

All provisions of existing implementing rules and regulations, circulars, department issuances, and other procedures corresponding to laws and any other law or parts of law specifically inconsistent with this IRR are hereby repealed or modified, accordingly.

Rule X
REVISION, AMENDMENT, AND EFFECTIVITY

Section 1. Amendment and Revision.

This IRR may be revised or amended by the PSU Board of Regents upon the recommendation of the University President, provided that a Committee shall be created to study and review any proposal to revised this IRR before the Board may act accordingly. The duly approved revised IRR shall be submitted to the CHED for information and for purposes of consultation.

Section 2. Effectivity.

These Implementing Rules and Regulations shall take effect fifteen (15) days after its publication in two (2) newspapers of general circulation and in the University website. This IRR shall also be registered with the Office of the National Administrative Register at the University of the Philippines Law Center, UP Diliman, Quezon City.

WE HEREBY CERTIFY TO THE CORRECTNESS OF THE FOREGOING IMPLEMENTING RULES AND REGULATIONS (IRR) APPROVED BY THE PSU-BOARD OF REGENTS PER BOARD RESOLUTION NO. 51 S. 2023 ADOPTED AT ITS 239TH SPECIAL MEETING ON MARCH 14, 2023 AT UNIVERSITY OF SCIENCE AND TECHNOLOGY OF SOUTHERN PHILIPPINES, CAGAYAN DE ORO CITY.
