[ Act No. 1260, November 14, 1904 ]

AN ACT APPROPRIATING THE SUM OF SIXTY-FIVE THOUSAND PESOS, PHILIPPINE CURRENCY, OR SO MUCH THEREOF AS MAY BE NECESSARY, FROM THE CONGRESSIONAL RELIEF FUND, TO BE LOANED TO THE PROVINCE OF ALBAY FOR THE CONSTRUCTION OF WAGON ROADS FROM TABACO TO LIGAO, AND FROM GUINOBATAN TO JOVELLAR, IN SAID PROVINCE.

By authority of the United States, be it enacted by the Philippine Commission, that:

SECTION 1. There is hereby appropriated, out of so much of the three-million-dollar Congressional relief fund as remains unappropriated in the Insular Treasury, the sum of sixty-five thousand pesos, Philippine currency, for the purpose of constructing wagon roads from Tabaco to Ligao and from Guinobatan to Jovellar, in the Province of Albay: Provided, That the provincial board of Albay appropriate not less than twenty-five thousand pesos, Philippine currency, from the provincial road fund and moneys of the Congressional relief fund now subject to appropriation by the provincial board: And provided further, That the money hereby appropriated shall be accepted by the provincial board of Albay as a loan, to be repaid without interest in three equal installments, the first within one year, the second within two years, and the third within three years from the date of the acceptance of the loan. The money so loaned shall, when repaid, revert to the Congressional relief fund.

SEC. 2. The money appropriated in section one of this Act shall he paid to the provincial treasurer of the Province of Albay upon the production by him to the Treasurer of the Philippine Islands of a certified copy of a resolution of the provincial board of the Province of Albay accepting such loan, with the conditions stated in section one hereof, and shall be disbursed by the provincial treasurer of Albay, unless the Civil Governor shall designate another person to act in that capacity, upon giving proper bond. The provincial treasurer, or other disbursing officer, as the case may be, shall pay all bills for services and material upon presentation of proper vouchers approved by the superintendent hereinafter provided for.

SEC. 3.  The Secretary of Commerce and Police is authorized and directed to cause the Warden of Bilibid Prison to furnish sufficient convicts to perform the necessary labor for the construction of the roads mentioned in section one hereof and to arrange for the necessary guards: Provided, That the additional cost of subsistence of convicts while on this work shall be a charge against the appropriation hereby made.

SEC. 4. The Consulting Engineer to the Commission shall have general supervision of the road construction herein provided for. He shall appoint a superintendent and fix his salary, subject to the approval of Hie Secretary of Commerce and Police. The superintendent shall have immediate charge of the work of construction; he shall appoint his assistants and determine their compensations; subject to the approval of the Consulting Engineer to the Commission; he shall make detailed monthly reports of the progress of the work, including a statement of expenditures made during the preceding month, and the purposes thereof, to the Consulting Engineer, who shall forward the same to the Secretary of Commerce and Police.

SEC. 5. The employees provided for in section four of this Act shall not necessarily be subject to the provisions of the Civil Service Act and Acts amendatory thereof, but employees belonging to the classified service may be temporarily transferred to the work without losing their status in the classified service.

SEC. 6. The Consulting Engineer to the Commission shall cause to be transferred for use on the roads mentioned in section one of this Act the necessary tools, supplies, and material, so far as they may he available, from those used in the construction of roads heretofore appropriated for by Acts of the Commission; and such other tools, supplies, and materials as may be required shall be purchased by the superintendent, with the approval of the Consulting Engineer to the Commission, through the Insular Purchasing Agent as provided by law, but the provisions of section one of Act Numbered Two hundred and thirty-one, as amended, are hereby made applicable to such purchases.

SEC. 7. The roads constructed under this Act shall thereafter he kept in repair by the provincial supervisor of Albay, under supervision and direction of the Consulting Engineer, and the cost of such repair shall be paid out of the treasury of the Province of Albay.

SEC. 8. The public good requiring the speedy enactment of this bill, the passage of the same is hereby expedited in accordance with section two of "An Act prescribing the order of procedure by the Commission in the enactment of laws," passed September twenty-sixth, nineteen hundred.

SEC. 9. This Act shall take effect on its passage.
