[ Act No. 3941, November 29, 1932 ]

AN ACT TO PROVIDE THAT THE MEASURING OF TIMBER IN THE LOCAL MARKET SHALL BO IN ACCORDANCE WITH THE REVISED ADMINISTRATIVE CODE, AND TO DECLARE UNLAWFUL THE USE IN THIS CONNECTION OF A TABLE KNOWN IN THE MARKET AS COMMERCIAL TABLE.

Be it enacted by the Senate and House of Representatives of the Philippines in Legislature assembled and by the authority of the same:

SECTION 1. In any commercial sale of timber in the local market, the timber shall be measured in accordances with the procedure prescribed in section fifteen hundred and ten of Act Numbered Twenty-seven hundred and eleven, known as the Revised Administrative Code, and the use of the so-called commercial table heretofore in vogue in the local market is hereby prohibited.

SEC. 2. In accordance with the provisions of the preceding section, any deduction from the total volume of the timber measured for sap wood, rot, cavities, or other natural defects and by blows of the axe, shall be limited only to the real defects of the timber and shall not include parts otherwise serviceable.

SEC. 3. Any person violating the provisions of this Act shall be punished by a fine of not less than twenty pesos nor more than live hundred pesos, or by imprisonment for not less than one month nor more than three months, or both, in the discretion of the court.

SEC. 4. No contract, rule or regulation of any kind tending to exempt the purchaser wholly or partly from his responsibility for the violation of any of the provisions of this Act shall be valid or effective.

SEC. 5. The Collector of Internal Revenue is hereby authorized to enforce the provisions of this Act and shall for this purpose have authority to promulgate such regulations as may be necessary, subject to the approval of the Department Head concerned.

SEC. 6. All acts or parts of acts inconsistent herewith are hereby repealed.

SEC. 7. This Act shall take effect on its approval.
