[ Act No. 1678, August 08, 1907 ]

AN ACT PROVIDING FOR THE PUBLICATION IN THE OFFICIAL GAZETTE OF CERTAIN NOTICES OF THE COURT OF LAND REGISTRATION AND AMENDING ACT NUMBERED FOUR HUNDRED AND NINETY-SIX, AS AMENDED.

By authority of the United States, be it enacted by the Philippine Commission, that:

SECTION 1. Section thirty-one of Act Numbered Four hundred and ninety-six, as amended by section six of Act Numbered Sixteen hundred and forty-eight, is hereby further amended so as to lead  as follows:
"SEC. 31. Upon receipt of the application, certificate, and accompanymg papers from the register of deeds, the clerk snail cause notice of the filing of the application to be published twice,  in successive issues of the Official Gazette, in both the English and  Spanish languages. The notice shall be issued by order of the  court, attested by the clerk, and shall be in form substantially as  follows:
"REGISTRATION OF TITLE.

"Province (or city) of ............................

"COURT OF LAND REGISTRATION.

"To [here insert the names of all persons appearing to have an interest and the adjoining owners so far as known], and to all wHom it may concern:

"Whereas an application has been presented to said court by  [name or names, and addresses in full] to register and confirm  his (or their) title in the following-described lands [insert description], you are hereby cited to appear at the Court of Land Registration, to be held at...................................., in said Province (or city)  of ...................................., on the ................................ day of................................, A. D. nineteen hundred and........, at............ o'clock in the forenoon, to show cause, if any you have, why the  prayer of said application shall not be granted. And unless you appear at such court, at the time and place aforesaid, your default will be recorded and the said application will be taken as confessed, and you will be forever barred from contesting said application or any decree entered thereon.

"Witness: ........................, judge of said court, this................day of...................................., in the year nineteen hundred and.........

"Attest:

"...................................
"Clerk of said Court."

SEC. 2. The publication in the Official  Gazette of the notice provided for in section one of this Act shall be in lieu of the publication thereof in the newspapers as heretofore provided, and all Acts and parts of Acts in conflict with this Act are hereby repealed.

SEC. 3. The public good requiring, the speedy enactment of this bill, the passage of the same is hereby expedited in accordance with section two of "An Act prescribing the order of procedure by the Commission in the enactment of laws," passed September twenty-sixth, nineteen hundred.

SEC. 4. This Act shall take effect on October first, nineteen Effective date. hundred and seven.
