[ Act No. 3195, November 29, 1924 ]

AN ACT TO AMEND THE PROVISIONS OF ARTICLE FOUR HUNDRED AND TWENTY-THREE OF THE PENAL CODE

Be it  enacted by the  Senate and. House of Representatives of the Philippines in Legislature  assembled and by the authority of the same:

SECTION  1. Article  four  hundred and  twenty-three of the Penal Code is hereby amended to read as  follows:

"Art. 423. Any husband who, having surprised his wife in the act of adultery, shall kill her or her paramour  in the act, or shall inflict serious  physical injuries  upon either, shall  suffer the penalty of destierro.

"If he shall inflict physical injuries of any other kind, he shall be exempt from  punishment.

"The penalty provided for in the first paragraph of this article shall likewise be imposed upon the wife who, having surprised  her  husband with  another woman under the circumstances above mentioned, shall kill either or both in the act or shall inflict serious physical injuries upon them, and she shall likewise be exempt from  punishment  if she shall inflict physical injuries of any other kind.

"These  rules shall be applicable  under similar  circumstances to the parents with respect to any daughter  under eighteen years of age and her seducer while the daughter is living with the parents.

"Any  person who shall promote or  facilitate the  prostitution of his wife or daughter shall  not be entitled to the benefits of this article."

SEC. 2. This Act shall take effect on  its approval.
