[ Act No. 1149, May 10, 1904 ]

AN ACT AMENDING THE CUSTOMS ADMINISTRATIVE ACT, NUMBERED THREE HUNDRED AND FIFTY-FIVE, SO AS TO AUTHORIZE THE CIVIL GOVERNOR TO SET APART CERTAIN PORTIONS OF THE WHARF, LANDING PLACE, STREET, OR OTHER PUBLIC GROUND ADJACENT TO THE SEASHORE AND CUSTOM-HOUSE IN ANY MUNICIPALITY FOR CUSTOMS PURPOSES, AND TO PLACE THE SAME UNDER THE JURISDICTION OF THE COLLECTOR OF CUSTOMS.

By authority of the United States, be it enacted by the Philippine Commission, that:

SECTION 1. Section twenty-six of the Customs Administrative Act, Numbered Three hundred and fifty-five, is hereby amended by inserting at the end of said section the following:
"Provided, however, That whenever, in the opinion of the Civil Governor, any public wharf, landing place, street, or land is necessary or desirable in loading and unloading ships, or for any proper customs purpose, at any port, of entry, he is hereby given power and authority, by executive order to declare that such wharf, landing place, street, or land shall he under the exclusive control and jurisdiction of the collector of customs or other customs official at such port of entry; but the exercise of such jurisdiction shall in no wise affect the general police powers of the municipality in which said wharf, landing place, street, or land is situated. After the issuance by the Civil Governor of an executive order setting apart such wharf, landing place, street, or land as above specified for customs purposes, all the provisions of this section shall apply thereto."
SEC. 2. The public good requiring the speedy enactment of this bill, the passage of the same is hereby expedited in accordance with section two of "An Act prescribing the order of procedure by the Commission in the enactment of laws," passed September twenty-sixth, nineteen hundred.

SEC. 3. This Act shall take effect on its passage.
