[ Act No. 3804, December 05, 1930 ]

AN ACT AUTHORIZING THE DIRECTOR OF LANDS TO ASSIGN TO PROVINCIAL TREASURERS THE FEES COLLECTIBLE FROM CADASTRAL SURVEYS, AND FOR OTHER PURPOSES.

Be it enacted by the Senate and House of Representatives of the Philippines in Legislature assembled and by the authority of the same:

SECTION 1. The Director of Lands, with the approval of the Secretary of Agriculture and Natural Resources, is hereby empowered to assign to provincial treasurers the fees collectible from cadastral surveys executed under Act Numbered Twenty-two hundred and fifty-nine, as amended, and under Act Numbered Thirty-three hundred and twenty-seven, as amended, at a discount of from six to eight per centum. The provincial treasurers may, with the approval of the provincial boards concerned and the Secretary of the Interior, pay the Bureau of Lands out of any funds they may have in their possession which are not needed for immediate use, based upon surplus provincial funds or trust fund not in excess of twenty per centum of the yearly average balance in the last three years immediately preceding the year of the assignment.

SEC. 2. In order to expedite the collection of cadastral costs, for which the provinces have made advance payments, the provincial treasurers may appoint the necessary employees at a compensation to be approved by the provincial board, and in cases of disagreement, the same shall be submitted to the Chief of the Executive Bureau whose decision thereon shall be final. The salaries of such employees shall be chargeable against the cadastral collections accruing to the provincial funds.

SEC. 3. This Act shall take effect on its approval.

Approved, December 5, 1930.
