[ Act No. 1054, February 20, 1904 ]

AN ACT TO AMEND SECTION ELEVEN OF ACT NUMBERED SIX HUNDRED AND NINETEEN, ENTITLED "AN ACT TO PROMOTE GOOD ORDER AND DISCIPLINE IN THE PHILIPPINES CONSTABULARY," SO AS TO PROVIDE THAT WHERE THE ACCUSED HAS BEEN CONVICTED BY SUMMARY COURT THREE TIMES WITHIN A YEAR HE MAY BE SENTENCED TO BE DISHONORABLY DISCHARGED AND TO FORFEIT ALL PAY AND ALLOWANCES DUE OR TO BECOME DUE, IN ADDITION TO ANY OTHER PENALTY PROVIDED BY LAW.

By authority of the United States, be it enacted by the Philippine Commission, that:

SECTION 1. Section eleven of Act Numbered Six hundred and nineteen, entitled "An Act to promote good order and discipline in the Philippines Constabulary" is hereby amended by inserting in the eighteenth line of said section, after the word "discharged" and before the words "in addition to the penalties herein before mentioned," the following words: ''and to forfeit all pay and allowances due or to become due," so that the proviso in which said insertion occurs shall read as follows: "Provided, That where the accused is a non-commissioned officer or a first-class private, he may be sentenced to reduction to the grade of second-class private in addition thereto, and that where the accused has been convicted by summary court three times within a year he may be sentenced to be dishonorably discharged and to forfeit all pay and allowances due or to become due, in addition to the penalties herein before mentioned."

SEC. 2. The public good requiring the speedy enactment of this bill, the passage of the same is hereby expedited in accordance with section two of "An Act prescribing the order of procedure by the Commission in the enactment of laws," passed September twenty-sixth, nineteen hundred.

SEC. 3. This Act shall take effect on its passage.
