AN ACT TO AMEND SECTION SIX OF ACT NUMBERED ONE HUNDRED FORTY-SIX, ENTITLED "AN ACT CREATING THE OFFICE OF INSULAR PURCHASING AGENT FOR THE GOVERNMENT OF THE PHILIPPINE ARCHIPELAGO, DENNING THE DUTIES OF SUCH OFFICER, AND MAKING AN APPROPRIATION OF ONE HUNDRED THOUSAND DOLLARS FOR THE PURPOSE OF CARRYING SAID ACT INTO EFFECT," AS AMENDED, BY AUTHORIZING THE CHIEFS OF BUREAUS AND OFFICES OF THE INSULAR GOVERNMENT TO MAKE REQUISITIONS FOR SUPPLIES WITHOUT THE APPROVAL OF THE HEADS OF DEPARTMENTS, AND FOR OTHER PURPOSES.

By authority of the United States, be it enacted by the Philippine Legislature, that:

SECTION 1. Section six of Act Numbered One hundred  and forty-six, as amended, is hereby further amended to  read as follows:
"SEC. 6. (a)  Each chief of Bureau or Office of the Insular Government or of a department of the city of Manila and each provincial treasurer and the treasurer of the city of Baguio or any other officer having administrative control over an appropriation shall make written requisition  from time to time upon the Purchasing Agent for all property or supplies he may require, and for the payment of partmenfhead"1 De" which he has an appropriation available: Provided, That nothing herein shall be construed to rescind the executive authority of the head of a Department over requisitions from Bureaus or Offices under his control in case he desires to exercise such authority.
"(b)  Payment for all articles and supplies so furnished shall be made to the Purchasing Agent at the actual cost thereof in the city of Manila, including freight and all other expenses incident to the delivery in the warehouse of the Purchasing Agent at Manila and five per centum additional upon such cost for freight, storage, bookkeeping, breakage, and other proper charges by the Bureau or Office, or provincial or city government receiving the same, from its available appropriations: Provided, That the Governor-General is hereby authorized and directed to fix the rate of surcharge at such other percentage of the cost of the supplies laid down in the warehouses of the Purchasing Agent as experience may show to be necessary and adequate to cover all the operating expenses of said office, including the expenses of delivery within the city of Manila at the premises of the Bureau, or Office, or on board ship for forwarding to points in the provinces; but in no case shall the total surcharges so imposed exceed seven and one-half per centum: And provided further, That no surcharge shall be made upon the cost of freight on delivery of supplies by the Bureau of Supply.
"(c)  The Executive  Secretary  shall have jurisdiction over and approve or disapprove all requisitions for property or supplies of every kind made upon the Purchasing Agent by any provincial or municipal official: Provided, however, That this provision shall not apply to the city of -Manila excepted. Manila, in which case the certificate of the Municipal Board approving the requisition shall be sufficient.
" (d)  No property or supplies of any kind purchased or procured under any requisition, as herein provided, shall be forwarded by the Purchasing Agent to any Bureau, Office, province, municipality, or other branch of the Government until after he has received a certificate signed by the chief of the Bureau or Office concerned, or by the provincial or municipal treasurer, as the case may be, that there is an appropriation available for the payment of the obligation and that there is sufficient money in said appropriation to pay for such property or supplies, including all proper expenses, and that the necessary sum of money has been set aside for such purpose."
SEC. 2. Section five of Act Numbered Twenty-one hundred and nineteen, and all other Acts or parts of Acts inconsistent with the provisions of this Act, are hereby repealed.

SEC. 3. This Act shall take effect on its passage.
