[ Act No. 3090, March 16, 1923 ]

AN ACT REQUIRING ALL PERSONS CLAIMING LANDS AS PRIVATE TO PLACE CONCRETE, STONE, OR WOODEN MONUMENTS AT THE CORNERS OF THEIR RESPECTIVE CLAIMS SITUATED IN THE DISTRICT, PROVINCE, MUNICIPALITY, OR REGION PROCLAIMED BY THE GOVERNOR-GENERAL SUBJECT TO FREE PATENT APPLICATIONS UNDER THE PROVISIONS OF SECTION FORTY-TWO OF ACT NUMBERED TWENTY-EIGHT HUNDRED AND SEVENTY-FOUR, AND FOR OTHER PURPOSES

Be  it enacted by the Senate and  House of Representatives of the Philippines  in Legislature  assembled and by the authority of the same:

SECTION  1. Whenever  the  public interests  require that titles  to lands be settled and adjudicated in accordance with the free patent provisions of the Public Land Act Numbered Twenty-eight hundred and seventy-four, and the Governor-General, under section forty-two  of said Act, fixes by proclamation  the period within  which  applications for free patents may be filed with the  Bureau of Lands in the district,  province, municipality,  or region specified in such proclamation, it  shall be the duty  of all persons claiming lands as  private situated within  said  district,  province, municipality, or region included in the proclamation of  the Governor-General to place or  cause to be placed concrete, stone or wooden monuments at the  corners of their respective claims  so as to indicate  the boundary lines thereof. This  law shall not be construed as changing1, altering, or in any way modifying  the provisions of the existing law relative to  the acquisition of  real property  in  the  Philippine Islands.   The  Director of  Lands shall give notice of such requirement to the general public by  publication in the  Official  Gazette in both English and Spanish languages once a week for a period of at least four weeks, and in one English and one Spanish newspapers published in  Manila or in  the district, province,  municipality,  or region, if any, for  a like period.  Such notice shall be furnished to the Provincial Board and Municipal Council  affected to be posted at conspicuous places in the provincial and municipal  buildings and at the bulletin board of each barrio of the municipality. It shall, moreover, be translated  into the local dialects and announced  by bandillos  or public  criers in all  the places affected once a week for a period  of four consecutive weeks.

SEC.  2.  Any claimant of such lands, who willfully refuses to  comply with the requirements of  the foregoing section within the period specified in the proclamation of the Governor-General, shall be guilty of  a misdemeanor,  and upon conviction  thereof by a  court of competent jurisdiction, shall  be punished by a fine not exceeding one hundred pesos or imprisonment not exceeding thirty days or by both such fine and imprisonment, in the discretion of said court.

SEC. 3.  This Act shall take effect on its approval.
