[ Act No. 3782, November 28, 1930 ]

AN ACT AUTHORIZING MACLEOD & COMPANY TO MAINTAIN AN ACTION AT LAW AGAINST THE GOVERNMENT OF THE PHILIPPINE ISLANDS TO RECOVER DAMAGES ALLEGED BY SAID COMPANY TO HAVE BEEN CAUSED TO ITS PROPERTY FACING THE PASIG RIVER IN THE CITY OF MANILA.

Whereas it is alleged that damage has been done to a certain wall, wharf, and warehouses of Macleod & Company on the Pasig River, in the City of Manila, by excessive dredging by the Bureau of Public Works which undermined the foundations of said wall and wharf;

Whereas the Director of Public Works has disclaimed all responsibility for the caving-in of the aforesaid wall and wharf;

Whereas the question as to who is liable for said damages can only be propeiiy determined by means of an action at law:

Now, therefore, in the interest of right and justice,

Be it enacted by the Senate and House of Representatives of the Philippines in Legislature assembled and by the authority of the same:

SECTION 1. Authority is hereby granted to Macleod & Company, a domestic corporation having its principal place of business in the City of Manila, to maintain an action at law against the Government of the Philippine Islands in the Court of First Instance of the City of Manila, Ninth Judicial District, to determine the liability and obligation of said Government of the Philippine Islands with regard to the caving-in of said wall and wharf and to fix the damages, if any, which Macleod & Company are entitled to recover, and to have judgment to that effect pronounced in said action.

SEC. 2. This Act shall take effect on its approval.
