[ Act No. 2345, February 28, 1914 ]

AN ACT TO AMEND SECTIONS TWO, FIVE, AND ELEVEN OF ACT NUMBERED TWENTY-THREE HUNDRED AND SIX, ENTITLED "AN ACT AUTHORIZING-THE GOVERNOR-GENERAL TO SELL OR LEASE THE BUILDINGS AND OTHER PROPERTY KNOWN AS THE INSULAR COLD STORAGE AND ICE PLANT AND TO LEASE THE LAND ON WHICH THE SAME IS SITUATED AND FOR OTHER PURPOSES." BY AUTHORIZING THE GOVERNOR-GENERAL TO WAIVE ADVERTISEMENT OR SHORTEN THE PERIOD THEREOF OR MODIFY THE CONDITIONS OF THE SAME AND FOR OTHER PURPOSES.

By authority of the United States, be it enacted by the Philippine Legislature, that:

SECTION 1. Section two of Act Numbered Twenty-three hundred and six is hereby amended by adding at the end thereof the following:
"Provided, That in case the Governor-General in his judgment shall find it more advantageous to the Government, he may waive the advertisement provided for in this section or shorten the period thereof or otherwise modify the provisions for advertisement, and accept any offer to lease or purchase the said plant that shall in his judgment best serve the rights and interests of the Government:And provided further, That in any such offer to purchase the plant accepted by the Governor-General, the purchaser shall keep the plant insured against fire, flood, earthquake, and wind for an amount equal to the sum of all the deferred payments together with interest thereon from the date of said purchase until the completion of the final payment thereon."


SEC. 2. Section five of said Act is hereby amended by adding at the end thereof the following:

"And provided further, That under no condition shall the lessee or purchaser be permitted to shut down the plant because of labor, financial, or other trouble, without forfeiture of an amount of its bond proportionate to the damage to the Government, and the Government shall have the right to enter and operate the plant at any time and to retain such proportion of the net profits as may be required to save harmless the Government under the terms of the contract of sale or lease in case the plant shall fail to give, in so far as its capacity shall warrant, adequate service to the public."
SEC. 3. Section eleven of said Act is hereby amended by adding at the end thereof the following proviso:
"Provided, however, That an amount not to exceed two hundred and sixty-five thousand pesos, out of the assets of the ice plant or of the rental payment for the lease thereof may be expended under the  direction of the Governor-General for the completion of the repairs and reconstruction now under way on the building, and the installation of the machinery already ordered."
SEC. 4. This Act shall take effect upon its passage.
