AN ACT TO AMEND SECTION ONE OF ACT NUMBERED TWENTY-THREE HUNDRED AND SEVENTY-SEVEN, IN THE SENSE THAT IN MUNICIPALITIES ORGANIZED UNDER ACT NUMBERED EIGHTY-TWO, THE DAYS OF COCK-FIGHTING MAY COINCIDE WITH THE DAYS OF EXPOSITION, FAIR OR CARNIVAL, UNDER CERTAIN CONDITIONS.

By authority of the  United States, be it enacted by the Philippine Legislature, that:

SECTION 1. Section one of Act Numbered Twenty-three Local fiestas, hundred and seventy-seven is hereby amended to read as follows:
"SECTION 1. Subsection (j) of section forty of Act Numbered Eighty-two, known as the Municipal Code, as amended, is hereby further amended to read as follows:
" ' (j)  To fix and change by resolution the date of the local fiesta, taking into account that in establishing the fiesta for the municipality, the council shall give preference to a date which, by reason of an important event in the municipality, the province, the Philippine Archipelago, and in general in the history of the Philippine Islands or of the United States, may be considered memorable and worthy of being commemorated by a local fiesta, and in order to be valid, the resolution changing the date of the local fiesta established in accordance with this subsection shall be passed by two-thirds of all the members of the municipal council, and such resolution changing the date of the local fiesta already established in accordance with the provisions of this subsection shall not be passed before the expiration of five years after the fixing of the date, and a local fiesta shall not be held oftener than once in each year, and precisely.on the date designated, except when for weighty reasons, such as typhoons, inundations, earthquakes, epidemics, or other public calamities the fiesta cannot be held on the date fixed, in which case it may be held on another date in the same year by resolution of the council; to regulate and permit or prohibit cockfighting and the keeping or training of fighting cocks, and to close cockpits, permitting cockfighting in licensed cockpits on legal holidays and for a period not to exceed three days during the celebration of the local fiesta, and not permitting any card games or games of chance of any kind on the premises of the cockpits: Provided, however, That in provinces where the provincial board resolves that a Fairs or expositions, fair or exposition of agricultural and industrial products of the province, a carnival, or any other act which may redound to the promotion of the general interests thereof, shall be held on a suitable date or dates, the council of the municipality in which such fair, exposition, or carnival is held may, by resolution of a majority of the council, authorize the cockfighting permitted at a local fiesta to take place for not to exceed three days during said exposition, fair, or carnival, if these fall on a date other than that of the local fiesta: Provided, That this shall not be construed to authorize, besides the cockfighting so transferred, additional cockfighting at the local fiesta, except such cockfighting as may be had if said local fiesta coincides with a legal holiday.' "
SEC. 2. This Act shall take effect on its passage.
