[ Act No. 2989, February 24, 1921 ]
AN ACT AUTHORIZING PRIVATE SURVEYORS TO MAKE CADASTRAL SURVEYS.
Be it enacted by the Senate and House of Representatives of the Philippines in Legislature assembled and by the authority of the same:
SECTION 1. The Director of Lands is hereby auhorized to assign to private surveyors such cadastral surveys as may have been ordered by the Governor-General, whenever such measure is required for the prompt adjudication of titles to said lands: Provided, however,That before making such assignment, the Director of Lands shall satisfy himself:
SEC. 3. The Director of Lands shall exercise strict supervision over the field and office work of such cadastral surveys to assure faithful compliance with all provisions of law and the regulations of the Bureau of Lands.
SEC. 4. This Act shall take effect on its approval.

SECTION 1. The Director of Lands is hereby auhorized to assign to private surveyors such cadastral surveys as may have been ordered by the Governor-General, whenever such measure is required for the prompt adjudication of titles to said lands: Provided, however,That before making such assignment, the Director of Lands shall satisfy himself:
(a) That such private surveyor is competent to execute a cadastral survey in accordance with the regulations, technical requirements, and standards of the Bureau of Lands, and that he has practiced the profession of surveyor for not less than three years prior to the making of such assignment.SEC. 2. The charges for the surveys made by a private surveyor in accordance with this Act, as stipulated in the contract for survey between such private surveyor and the claimants of the land, shall constitute a first lien thereon: Provided, however, That none of the provision of this section shall be construed to oblige the Government to pay fees of private surveyors for surveys of public lands surrounded by private lands claimed in the same cadastral proceedings: Provided, further, That the provisions of section eighteen of Act Numbered Twenty-two hundred and fifty-nine, as amended, shall not be applicable to survey contracts made in accordance with the provisions of this Act, except so far as the cost of the judicial registration proceedings is concerned.
(b) That such private surveyor has made satisfactory arrangements with the occupants or claimants of the land to be surveyed, with the sanction and approval of the municipal council, for the amount and the terms of payment for his services in surveying such land.
(c) That such private surveyor has given a bond satisfactory to the Director of Lands, in an amount to be fixed by the latter, sufficient to guarantee the faithful execution of the work by such private surveyor and to cover the cost of any correction work that may have to be done by the Bureau of Lands.
SEC. 3. The Director of Lands shall exercise strict supervision over the field and office work of such cadastral surveys to assure faithful compliance with all provisions of law and the regulations of the Bureau of Lands.
SEC. 4. This Act shall take effect on its approval.
