[ Act No. 4059, March 01, 1933 ]

AN ACT MAKING APPROPRIATIONS FOR PUBLIC WORKS AND FOR OTHER PURPOSES.

Be it enacted by the Senate and House of Representatives of the Philippines in Legislature assembled and by the authority of the same: 

SECTION 1. The following sums, or so much thereof as may be necessary, are hereby appropriated out of any funds in the Insular Treasury not otherwise appropriated, to be at the disposal of the Director of Public Works, subject to the approval of the Secretary of Public Works and Communications and the provisions hereinafter set forth, for the purposes mentioned hereunder:

SEC. 2. All balances of the several appropriations made by this Act, the destination of which has not been determined by proper authority on December thirty-first, nineteen hundred and thirty-three, and all balances of appropriations remaining free or unexpended on July thirty-first, nineteen hundred and thirty-four, shall revert to the unappropriated funds in the Insular Treasury, and thereafter shall not be available for expenditure except upon appropriation by the Legislature. 

SEC. 3. The sums appropriated in paragraphs (a), (e), (f), (g), (j), (k), (l), (ll), (q), (s)  and (u) shall be released and distributed in the discretion of the Secretary of Public Works and Communications; provided that no funds shall be expended from the appropriations in the other paragraphs of this Act, which shall not have accrued as income for the current fiscal year from the regular sources of revenue and only with the approval of the Governor-General and upon the recommendation of the Secretary of Finance to this effect. 

SEC. 4. Any provision of existing law to the contrary notwithstanding, the Secretary of Finance may authorize the expenditure of any appropriation or portion thereof made in this Act or Act No. 3913 for school buildings in any municipality for the operation and maintenance of existing classes in the same municipality: Provided however, That no part of said appropriation thus authorized shall be spent for increasing teachers' salaries: And provided, further, That no part of this appropriation shall accrue to the Teachers' Pension Fund. 

SEC. 5. The provisions of any existing law to the contrary notwithstanding, any municipal project specified herein, the appropriation for which does not exceed P4,000, may be undertaken by the municipal authorities under the supervision of the district engineer. 

SEC. 6. The sum of five thousand (P5,000) pesos for the Lumbangan school, Nasugbu, Batangas, and the sum of four thousand (P4,000) pesos for Balete school, Lipa, Batangas, as provided in Act 3813, and the sum of three thousand (P3,000) pesos for the Oroquieta home economics building, Occidental Misamis, as provided in Act 3813 as amended by Act 3972, are hereby reappropriated for the same projects extending their reversion until July 31, 1933. 

SEC. 7. This Act shall take effect on January first, nineteen hundred and thirty-three.
