[ Commonwealth Act No. 211, November 21, 1936 ]

AN ACT TO FIX A. MINIMUM DAILY WAGE FOR LABORERS EMPLOYED IN PUBLIC WORK, AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF.

Be it enacted by the National Assembly of the Philippines:

SECTION 1. All laborers employed by corporation, person, or persons in any public work shall receive a minimum daily wage of one peso. In the ease of provincial and municipal public works, the province or municipality may pay lower wages, if financial conditions of the province or municipality so demand.

SEC. 2. The contractor and each subcontractor shall keep, or cause to be kept, an accurate record showing the names and occupations of all laborers employed by him, in connection with the said public work, and showing also the actual daily wage paid to each of such workers. Said record shall be open during all reasonable hours to the inspection of the public body awarding the contract and its officers and agents.

SEC. 3. Any officer, agent, or representative of the Government of the Philippines, or of any political subdivision thereof, who shall willfully violate or omit to comply with any of the provisions of this Act, and any contractor or subcontractor, or agent or representative thereof, doing public work as aforesaid, who shall violate this Act or neglect to keep, or cause to be kept, an accurate record of the names, occupation, and actual wages paid to each laborer employed by him in connection with the said public work or who shall refuse to allow access to same at any reasonable hour to any person authorized to inspect same under this Act, shall be punished by a fine of not exceeding one thousand pesos, or by imprisonment for not exceeding six months, or both, in the discretion of the court.

SEC. 4. This Act shall take effect on January first, nineteen hundred and thirty-seven.
