[ Commonwealth Act No. 194, November 18, 1936 ]

AN ACT TO PROVIDE TOR THE DECISION OF TIES IN ELECTIONS FOR MEMBERS OF THE NATIONAL ASSEMBLY.

Be it enacted by the National Assembly of the Philippines:

SECTION 1. Whenever it shall atroear from the canvass in a regular or special election for Member of the National Assembly that two or more candidates have obtained the same plural number of votes, the provincial board of canvassers concerned shall proclaim that candidate elected who shall be favored by fortune in the drawing herein provided for, and the candidate so proclaimed shall he entitled to a seat in the National Assembly as if he had obtained a majority of votes.

SEC. 2. As soon as the canvass shall result in a tie, the provincial board of canvassers, after stating this fact in the proper certificate, and after giving all tied candidates ten days' notice in order that they may be present if they so desire, shall hold another public session at which a drawing shall be held, and minutes shall forthwith be prepared of the procedure followed in the drawing, of the result of said drawing and of the proclamation of the candidate-elect. Certified copies of said minutes shall be sent to the National Assembly, the President of the Philippines, and the Auditor General, and to each of the tied candidates.

SEC. 3. This Act shall take effect on its approval.
