[ Commonwealth Act No. 40, October 12, 1936 ]

AN ACT TO REVIVE CIVIL CASE NO. 47549 OF THE COURT OF FIRST INSTANCE OF MANILA, BY REPEALING SECTION’ TWO OF ACT NUMBERED FORTY-TWO HUNDRED AND SIXTY.

Be it enacted by the National Assembly of the Philippines:

SECTION 1. Section two of Act Numbered Forty-two hundred and sixty is hereby repealed, and all proceedings, judicial or otherwise, especially those in Civil Case No. 47549 of the Court of First Instance of Manila, instituted in connection with the unclaimed balances in the Philippine Postal Savings Bank as shown by liquidations made in 1933 and 1935, are hereby declared valid, and are reinstated and revived as of November 6, 1935: Provided, That all sums to be realized from the escheat to the Commonwealth of the Philippines of unclaimed balances in the Philippine Postal Savings Bank, as a result of the proceedings in Civil Case No. 47549 of the Court of First Instance of Manila, should be turned over to the aforesaid Bank, after deducting all expenses incident to the aforesaid proceedings.

SEC. 2. This Act shall take effect upon its approval.
