[ Commonwealth Act No. 469, June 15, 1939 ]

AN ACT APPROPRIATING EIGHT MILLION ONE HUNDRED EIGHTY THOUSAND PESOS FOR PUBLIC WORKS.

Be it enacted by the National Assembly of the Philippines:

SECTION 1. The following sums or so much thereof as may be necessary, are appropriated out of the general funds in the Philippine Treasury not otherwise appropriated, to be spent by the Director of Public Works, subject to the approval of the Secretary of Public Works and communications and the provisions hereinafter set forth, for the purposes mentioned hereunder:
A. BUILDINGS
(a)For the enlargement of the infirmary of the Eversley Childs Treatment Station at Mandawe, Cebu
P12,000.00
  
(b)For the construction, repairs, improvement, and extension of the following river control projects:

SEC. 2. The following sums, or so much there of as may be necessary, are appropriated out of the Cocunut Oil Excise Tax Fund, to be spent by the Director of Public Works, subject to the approval of the Secretary of Public Works and Communications and the provisions hereinafter set forth, for the purposes specified hereunder:
A. MISCELLANEOUS
(a)For aid for the construction, reconstruction, repair, improvement, extension and completion of public works in the following provinces and chartered cities: Provided, That where appropriations are authorized for the construction of roads and bridges and provinces or chartered cities concerned shall provide annually the necessary appropriations for the all provincial and city roads now in existence and those herein authorized to be determined by the Director of Public Works.

SEC. 3. The following sums, or so much thereof as may be necessary, are appropriated out of the "Port Works Fund" under Act Numbered Three thousand five hundred ninety-two, as amended by Commonwealth Act Numbered One hundred thirty, not otherwise appropriated, to be spent by the Director of Public Works, subject to the approval of the Secretary of Public Works and Communications and the provisions hereinafter set forth, for the purpose mentioned hereunder:
(A)
INVESTIGATION, CONSTRUCTION, AND IMPROVEMENT OF PORTS, LIGHTHOUSES BUOYS, BEACONS, AIR PORTS, LANDING FIELDS, AND OTHER AIDS TO NAVIGATION.
  
(a)For the construction and improvement of National Ports as follows: (Items omitted)
Total for National Forts ............. P1,700,000.00 Provided, That subject to the approval of the Secretary of Public Works and Communications and with such security as he may require, materials and derived from dredging may be used for filing in private property at the request of any landowner upon the condition that the cost thereof shall be paid by the owner of the land in annual installments not to extend more than five years.
(b)For the construction and improvement of municipal ports as follows: (Items omitted) Total for Municipal Ports

(c)For investigation and survey of portworks projects and foreshore leases

(d)For the construction and improvement of lighthouses and other aids to navigation

(e)For the construction and improvement of National air ports and landing fields

GRAND TOTAL FOR THE APPROPRIATIONS MADE IN THIS ACT: EIGHT MILLION ONE HUNDRED EIGHTY THOUSAND PESOS
P8,180,000.00
SEC. 4. All balances of the appropriations made in sections One, Two and Three of this Act, remaining un-expected on June thirty, nineteen hundred forty-two shall revert to the General Funds, the Coconut Oil Excise Tax Fund, and the Portworks Fund created by Act Numbered Three Thousand Five hundred and ninety-two, as amended by Commonwealth Act Numbered One hundred thirty, respectively, and thereafter they shall not be available for expenditure, except upon appropriation by the National Assembly.

SEC. 5. The sums appropriated in paragraphs (c), (d), (e), and (f) of section two, and those appropriated in paragraphs (c), (d) and (e) of section three of this Act shall be distributed by the Secretary of Public Works and Communications with the approval of the President of the Philippines, but those appropriated in the other paragraphs os section two and three hereof, except those appropriated in paragraph (b) of section two which shall be distributed as directed by the President of the Philippines and those appropriated in paragraphs (a) and (b) of section one shall be available for expenditure by the Director of Public Works. All sums appropriated in section three of this Act shall be released only after certification by the Auditor-General, to the President of the Philippines that there are sufficient funds that have accrued under Act Numbered Three thousand five hundred ninety-two, as amended by Commonwealth Act Numbered One hundred thirty, to cover the items of appropriation herein authorized.

SEC. 6. The President of the Philippines in authorized to suspend or otherwise stop the expenditure of any amount herein appropriated for any purpose, or any portion thereof, whenever in his opinion, the public interest so requires and thereupon the funds affected by such action shall become available for any other authorized expenditures as the President may determine.

SEC. 7. This Act shall take effect upon its approval.
