[ Commonwealth Act No. 658, June 21, 1941 ]

AN ACT APPROPRIATING FIFTEEN MILLION SEVEN HUNDRED SIXTY THOUSAND FIVE HUNDRED PESOS FOR PUBLIC WORKS.

Be it enacted by the National Assembly of the Philippines:

SECTION 1. The following sums, or so much thereof as may be necessary, are appropriated out of the proceeds of the sale of bonds issued or to be issued under the provisions of the Commonwealth Act entitled "An Act to provide for the issue of bonds of the Government of the Commonwealth of the Philippines for replacement of the amount to be transferred from the government center fund reserve to the unencumbered surplus of the general fund, for the construction of public improvements, and for such other purposes as may be authorized by law" to be spent by the Director of Public Works, subject to the approval of the Secretary of Public Works and Communications and the provisions hereinafter set forth, for the purposes speceified hereunder:

SEC. 2. The following sums, or so much thereof as may be necessary, are appropriated out the "Port Works Fund" under Act Numbered Three thousand five hundred ninety-two, as amended by Commonwealth Act Numbered One hundred thirty, not otherwise appropriated, to be at the disposal of the Director of Public Works, subject to the approval of the Secretary of Public Works and Communications and the provisions hereinafter set forth, for the purposes specified hereunder:

SEC. 3. No amount appropriated in this Act shall be set up in the books of the General Auditing Office or otherwise made available for expenditure unless previously authorized by the President of the Philippines.

SEC. 4. The sums appropriated in items (a), (b), (d), (k), (l), (m), (n), (o), (p), and (r) of section 1, and in paragraphs (c) and (d) of section 2, of this Act, shall be distributed by the Secretary of Public Works and Communications with the approval of the President of the Philippines, but those appropriated in the other items, except those in items (p) and (s) of section 1, shall be available for immediate expenditure by the Director of Public Works.

SEC. 5. All balances of the appropriations provided in section 1 of this Act remaining unexpended on June thirtieth, nineteen hundred forty-four, shall revert to the unappropriated portion of the Bond Fund constituted by the proceeds of the sale of bonds mentioned in section 1 hereof, and thereafter such balances shall not be available for expenditure except upon appropriation by the Congress of the Philippines; and all balances of the appropriations made in section 2 hereof remaining unexpended on June thirtieth, nineteen hundred forty-four, shall revert to the "Port Works Fund" created by Act Numbered Three thousand five hundred ninety-two, as amended y Commonwealth Act Numbered One hundred thirty, and thereafter shall not be available for expenditure except as provided in said Act.

SEC. 6. The President of the Philippines is authorized to suspend or otherwise stop the expenditure of any amount herein appropriated for any purpose, or any portion thereof, whenever in his opinion the public interest so requires, and thereupon the funds affected by such action shall become available for expenditure in connection with the national defense of, and the protection of the civilian population in, the Philippines in case of any grave national emergency, including increases in the expenses of the Philippine Army and the Philippine Constabulary as well as expenses for the organization of volunteer or home guards, or for any other expenditures authorized in this Act as the President may determine.

SEC. 7. This Act shall take effect upon its approval.
