AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE FEDERATED STATES OF MICRONESIA CONCERNING CULTURAL COOPERATION

The Government of the Republic of the Philippines and the Government of the Federated States of Micronesia;

Desirous of strengthening the spirit of cooperation and friendship existing between the two countries;

Inspired by the common desire to promote and develop cultural relations and understanding between their respective peoples;

Have agreed as follows:

ARTICLE I

Each Government shall, subject to its laws and regulations, endeavor to accord to the other every possible facility to ensure better understanding of their respective cultures through the exchange of:

1. Books, periodicals, and other publications relating to history, arts, literature, science and education;

2. Cinematographic films including television and radio programmes dealing with culture, arts, science and education; and

3. Art and cultural exhibitions.

ARTICLE II

Both Governments shall, subject to the laws and regulations of each country, and within their available resources, encourage the exchange between their countries of professors, scholars, journalists and members of scientific and cultural institutions.

ARTICLE III

Each Government shall, subject to its laws and regulations, encourage the establishment in its territory of associations of the other devoted to educational and cultural pursuits.

ARTICLE IV

Each Government shall encourage in its territory the establishment of Philippine-Micronesia Friendship Associations.

ARTICLE V

Each Government shall, within their available resources, encourage efforts to provide the nationals of the other country with scholarships and other facilities for study and research in the scientific, technical and cultural fields, including research projects on pre-historic and historic ties between the two countries.

ARTICLE VI

Both Governments shall encourage sports competitions between the irrespective nationals as well as exchanges of coaches and training techniques between their recognized sports organizations.

ARTICLE VII

Both Governments shall prevent the illegal trafficking of cultural property.

ARTICLE VIII

The two Governments shall consult with each other to review the operation of this agreement and to negotiate, when deemed necessary, the implementation of the provisions of this Agreement.

ARTICLE IX

This Agreement shall not affect the validity or execution of any obligation arising from other international agreements, conventions, treaties or protocols concluded by either government.

ARTICLE X

The Government of the Republic of the Philippines has designated its Department of Foreign Affairs on the one hand and the Government of the Federated States of Micronesia has designated its Department of External Affairs on the other hand as their implementing departments for the purpose of this Agreement. The implementing department shall communicate through diplomatic channels.

ARTICLE XI

This Agreement shall enter into force on the date of the exchange of notes confirming its ratification/approval by the two Governments. It shall remain in force for a period of five years and shall continue in force thereafter unless sooner terminated by either Government by three months prior notice in writing.  Projects which, at the expiration of this Agreement, have already been commenced but have not been fully implemented, shall be carried out to their completion in accordance with the provisions of this Agreement, unless there is a mutual agreement to terminate.

Either Government may propose in writing amendments thereto to which the other government will reply within 120 days upon receipt of such notice. Any amendment shall come into force after formal written approval has been given by both Governments.

Done in duplicate in Manila, this 30th day of January in the year of our Lord, One Thousand Nine Hundred and Eighty Nine, both in the English language, each being equally authentic.
