AGREEMENT BETWEEN THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES AND THE GOVERNMENT OF THE REPUBLIC OF KAZAKHSTAN ON VISA EXEMPTION FOR CITIZENS - HOLDERS OF DIPLOMATIC AND OFFICIAL PASSPORTS

The Government of the Republic of the Philippines and the Government of the Republic of Kazakhstan, hereinafter referred to as "the Parties",

desiring further to expand bilateral relations,

have agreed as follows:

ARTICLE 1

The citizens of the state of one of the Parties holding valid diplomatic and official passports, not accredited in the territory of the state of the other Party, may enter, exit, transit and temporarily stay in the territory of the state of the other Party without visas for a period of 30(thirty) days from the date of entry.

The citizens of the state of one of the Parties holding valid diplomatic and official passports during their stay in the territory of the state of the other Party shall observe the national legislation of the state of that Party.

ARTICLE 2

The citizens of the state of one of the Parties holding valid diplomatic and official passports travelling to the state of the other Party to assume their posts at their diplomatic mission, consular office and international organization shall be required to obtain visas valid for the duration of their assignment. This provision shall also apply to the members of the families of officials of diplomatic missions and consular offices and dependants if they are holders of diplomatic or official passports or their names are entered in their father's or mother's passport.

ARTICLE 3

The citizens of the states of the Parties holding valid diplomatic and official passports assigned to diplomatic missions, consular offices or international organizations and members of their families shall secure visas before departure for posts.

The authorized organ of the state of the sending Party shall inform the authorized organ of the state of the receiving Party about appointments of appropriate persons in diplomatic mission, consular office or international organization in advance.

ARTICLE 4

The citizens of the state of one of the Parties holding valid diplomatic and official passports may enter the territory of the state of the other Party at all entry points opened for international traffic.

ARTICLE 5

Each Party reserves the right to refuse entry, shorten or even terminate the stay of the citizen of the state of the other Party if such citizen is considered to be undesirable or persona non grata without giving any reasons.

ARTICLE 6

The authorized organs of the states of the Parties within 30 (thirty) days after signing the present Agreement shall exchange the specimens of valid diplomatic and official passports through diplomatic channels.

Any Party modifying its passports shall present to the other Party specimens of the new passports and inform the other Party about conditions of their use within (30) days before they come into use.

ARTICLE 7

In case of occurrence of disagreements at interpretation or application of provisions of the present Agreement, the Parties will solve them by means of negotiations or consultations.

ARTICLE 8

With mutual consent the Parties may amend or alter the present Agreement by additional protocols, which shall be considered as integral parts of this Agreement and shall enter into force in accordance with Article 10 of the present Agreement.

ARTICLE 9

The present Agreement shall not affect the rights and obligations of the Parties arising from other international treaties, to which they are parties.

ARTICLE 10

The present Agreement is concluded for an unlimited period and shail come into force on the date of the last written notification reporting completion by the Parties of the internal procedures necessary for its enforcement.

Each Party may terminate the present Agreement by written notification to the other Party. The present Agreement shall terminate six (6) months from the date of sending by one of the Parties of such notification to the other Party.

Done at Manila this 11th day of November, 2003 in duplicate, each in the Kazakh, English and Russian languages and all texts being equally authentic. In case of any divergence in interpretation of the provisions of the present Agreement, the English text shall prevail.
