AGREEMENT ON COOPERATION BETWEEN THE NATIONAL PROSECUTION SERVICE OF THE DEPARTMENT OF JUSTICE OF THE REPUBLIC OF TFIE PHILIPPINES AND THE SUPREME PEOPLE' S PROCURATORATE OF THE PEOPLE' S REPUBLIC OF CHINA

The Supreme People' s Procuratorate of the People' s Republic of China and the National Prosecution Service of the Department of Justice of the Republic of the Philippines (hereafter referred to as "the Parties" ),

Desiring to strengthening the ties of friendship and cooperation between the Parties and their subordinate organs or units in the two countries, on the basis of the mutual respect for sovereignty, equality and mutual benefit, and in light of actual needs for their respective work,

Have reached the follows:

1. The Parties shall strengthen cooperation between themselves and their subordinate organs in the two countries within the limits of their respective functions and powers and in accordance with their respective laws, rules and regulations.

2. For the purpose of requesting and rendering legal and judicial assistance the Parties shall communicate through diplomatic channels.

3. The Parties shall explore possible cooperation in the training of the professional prosecutorial and procuratorial staff and in the research and study of theory and principles relative to their work, the details of which shall be determined through consultation. ;

4. The Parties may send their respective delegations to visit each other and discuss issues of common interest.

5. The Parties may exchange copies of relevant laws, existing jurisprudence, legal publications and other information about their work that both have an interest in upon the request of the other Party.

6. In the process of the above cooperation, additional arrangements may be entered into, if necessary.

7. The Parties shall solve problems arising in the course of implementation of the Agreement through consultation and in accordance with the principle of mutual understanding and mutual respect.

8. This Agreement shall enter into force upon compliance by the Parties of their respective domestic requirements. Upon entering into force, the same shall remain in effect for five years and shall be automatically renewed for subsequent five-year terms if neither of the Parties expresses its intention to terminate it by giving a written notice to the other Party six months before the date of expiration of its validity.

Done at Beijing, this 18th day of October 2000, in two original copies each in English and Chinese languages, both texts being equally authentic.
